Don't file an application to change your defence.

C-M, it's admirable that you are trying to advise this OP in this most hopeless of hopeless cases, but he seems determined to ignore any advice from this forum, and blindly stumble his own way with absolutely no clue as to what he is doing.

No doubt when it gets to court and the Judge awards the claim to the Claimant, he will organise a demonstration outside the court building, against the court's apparent support of an illegal scam.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

All packed now, leaving early tomorrow.

So won't be available to write rude comments about people for at least a week!

  • Don't file an application to change your defence.

NOT A SINGLE PERSON DOES THAT JUST BECAUSE THE OTHER SIDE'S WS ARRIVES!

You simply make short, concise bullet point notes and address your concerns about their evidence at the hearing.  Don't say ''that landowner authority is illegal'' because it isn't...what you do is ''invite the Judge to find that...'' (what?)

    - the signs are unclear/too small writing?
    - and/or maybe that the landowner authority is questionable?
    - Certainly point out that a parking firm can't add £60 on top of a parking charge where the rationale requires it to include all costs, already.    The Supreme court made that rationale clear in paras 98, 193 and 198 of the ParkingEye v Beavis case (three times) and before that, in 2011 in the High Court decision in ParkingEye v Somerfield, HHJ Hegarty specifically addressed the fact (at para 419) that adding £60 on top of an already inflated parking charge is not recoverable and would be a penalty.

Hence why by the time of Beavis (parking event in 2013, decision in 2015) ParkingEye had stopped adding it.

None of this needs yet more paperwork fired at the Judge.   No application.
    Thanks this is help full

I do would like to see a huge demonstration out side Northampton Court against all parking tickets
But that's just an administrative centre, staffed by civil servants simply distributing the paperwork relating to any MCOL claim, just like a giant mailroom.  Distributing parking-related claims paperwork is only a minor part of the work they undertake.

You really do need to understand how the land lies before inciting public unrest. A total waste of time marching on Northampton!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

If you're going to have the impact you seem to think you should, then get yourself and your brigade to Westminster, Buck House, Windsor Castle .... but the CCBC in Northampton? ... F F S, about as much chance of lighting the skies there as would a wet Roman Candle on Bonfire Night.

    Do a proper job! 😃

I believe there are a couple of places on the forum where you can vent your anger, one is the Praise, Vent & Warnings board and the other is was Money Savers Arms (just checked and it's closed) which would be better places for your rantings.  I don't believe you should be going around trying to stir up civil unrest and certainly not on a forum designed to help posters.
