hi, and welcome to the forum ....boy are you in for a shock at the murky world you have fallen into ......you need to read the newbies forum especially the bit re courtsthe newbies thread/ discussion
https://forums.moneysavingexpert.com/discussion/4816822/newbies-private-parking-ticket-old-or-new-read-these-faqs-first-thankyouThere are no private parking rules ... The IPA /IAS is a boys club for its memberswhat MP's think" is very clear to me that there is collusion between parking companies and solicitors’ firms—so-called roboclaims companies. "
"They are often set up adjacently and involve the same directors and personnel. Incidentally, the same personnel get involved in the so-called appeals bodies."
"Essentially, it is a money-making enterprise that takes advantage of motorists up and down the country. They operate in a very business-like fashion, which is why I call them roboclaims companies."
"The companies are jamming up parts of our legal system."
“I now pretty much know exactly how the parking companies and in particular the IPC have been running this scam for the past 5 years. Basically both of the appeals processes are a complete and utter sham, (and part of that sham is Gladstones Solicitors itself)”
"The appeals process at Excel/VCS is run by a team of minimum wage office workers with no legal knowledge or experience whatsoever,"
" It is claimed by the head of the appeals service (retired Judge Bryn Holloway) that this is a completely independent fair process, it is not”
"The letter mentions two individuals—Will Hurley and Bryn Holloway—and concludes this is a typical example of the clear collusion between the IPC, their members and the IAS"
"what we can do about roboclaims companies and solicitors firms that profit, often in shady ways"
" the very large amounts of money that can be involved in such scams—a company called Smart Parking was involved in one such scam on my patch"
"tightening up the rules regarding the unfair use of automatic number plate recognition" "BW Legal, regularly issues 10,000 county court judgments a month, and is known to have issued 28,000 in one month"
"They are jamming up our court system, and are often totally unjustified."
" because the lifeblood of trying to extort money from people is having access to their details."

You point out to the court that you have the original document, you will present it in a face to face hearing, and the court can convince themselves of its authenticity
At that point you would wish the Cs representative who has presented this false instrument to the court - the Cs altered NtK - AND the person who wrote the witness statement that introduced this false instrument to be taken to task for this.
OP - if you can show us the two doucments, your original plus the one submitted and their submission that you altered your court exhibit, it would be great to see.3 -
If you think that a solicitor is committing fraud you should reporrt the matter to the SRA

Abuse of Process ... District Judge tells BWLegal
https://forums.moneysavingexpert.com/discussion/6014081/abuse-of-process-district-judge-tells-bwlegal/p1?new=1
And, here is a thread with a letter for you to send
https://forums.moneysavingexpert.com/discussion/6129744/bwlegal-the-scam/p1?new=1
BUT ......... all claims from BWLegal must now comply with the new CPR and as they lie about their fake £60, will they lie in the Witness Statement ...... BWLegal could well be the first to be found in contempt ...Amendments to the Civil Procedure Rules bring mandatory changes to statements of truth
For witness statements, the statement of truth’s wording will be as follows:
I believe that the facts stated in this witness statement are true. I understand that proceedings for contempt of court may be brought against anyone who makes, or causes to be made, a false statement in a document verified by a statement of truth without an honest belief in its truth.4 -
Okay. IPC rules mean absolutely diddly-squat. They are merely a Code of Practice and have no legal basis. The Private Parking Industry has laws it is expected to follow. These being the Protections of Freedoms Act 2012 Schedule 4 (can be viewed online, http://www.legislation.gov.uk/ukpga/2012/9/schedule/4/enacted) it is LAW. Therefore it overrules any of the cobblers that the IPC and BPA Code of Conduct has to offer, they can quote it as much as they want, it will not hold up in court if argued correctly in defence and suitable proof provided. They always choose to ignore PoFA 2012 when it comes to recovering charges.
Now they do have to offer a discount if paid withing 14 days, it's law and is in PoFA 2012 S4, although I do not recall how much the discount is. It's in PoFA2012 somewhere.
Has the driver been identified? (Don't do this whatever they say). Have they added extra charges onto the amount on the Notice to Keeper?
I would report BW Legal to the Solicitors Regulation Authority.
Do not give in to Private Parking firms. Fight them all the way!5 -
Norfolk_Boi .. yup, These dodgy bods live in cloud cuckoo land thinking that the CoP of the BPA and IPC is a licence to add unlawful amounts. They also forget about the Supreme court saying the ticket price includes the operation which means no fake debt collection charges or the other rubbish they add on.
They are stupid enough to ignore S71(2) of the Consumer Rights Act 2015
The courts really need to get bigger and stronger canes for the spankings as at present the penny has not dropped with the {Text removed by Forum Team}

What has the retail park said?
As principal, they are jointly liable for the actions of their agents, the offsetting company and as such need to be fully dragged into thisFrom the Plain Language Commission:
"The BPA has surely become one of the most socially dangerous organisations in the UK"2 -
I dont actually think there is any fraud going on here at all and i think this been all blown up out of all proportion
What is being stated will be waved away by a judge3 -
