    change the boot type to efi in the bios, or format the disk to mbr

    Thank you I tried that but I still get the above any idea?
    You need to get rid of the partition in the middle. Basically, you need to remove all the partitions (because you can't have a mix of GPT and MBR partitions on the same disk) and let Windows create its own partition.

    Waste of time the pc has booted in legacy , the disk is gpt, delete the partition leaves the disk as gpt, stop wasting thomas’ time

    Are you serious , the type of disk is in boot block one , you need to create a new partition table.

    Agreed. Get rid of all partitions so you're left with only unallocated space, and then let the Windows install create the partitions it needs.

    Sorry, I re-read your post, I thought you said 'THEY will still be a gpt, empty', meaning that if you delete the partitions, they will still be there, but empty. That's why I thought "how can the partition still be there, if you've just deleted it".
    Yes, if the disk is GPT, you need to 'clean' it using diskpart (the easiest option), but you still need to get rid of all the partitions.

    I'd started typing but got distracted with something else ... I didn't refresh before hitting submit so didn't see your posts at all.

    All I know is (when I clean installed W10 to my SSD) that there were no partitions, only unallocated space, and the W10 install created everything it needed.

    If Thomas wants to use EFI (which the disk used before) he needs to change the BIOS, otherwise no need to use diskpart he just need to click on Format on the install screen
