its impossible to contact LH but noticed they have adjusted the page to include an address for legal proceedings or notifications.Wondering if they refuse a refund if that’s an option for MCOL instead?0 -
If you paid via card , I personally would go down that route before as it's free.

I'm considering an alternative route if I get nowhere with LH and ABTA. It seems that ABTA are providing guidance to its members which are not compliant with package holiday regulations. I have sympathy, but they are breaking the law.
Anyway, under the chargeback scheme (not section 75 which is only for credit card purchases) you are entitled to ask your bank to recover your money if you can evidence that the service you paid for has not been provided. If you have evidence that the flight or the accommodation cannot be provided (cancellation) and a copy of your terms and conditions, then you can show that the contract has not been met. The 120 day limit on chargeback does not affect you for future services, it starts from when the service was due to be provided or from when you were informed of cancellation.
I made the important point above that you may not have a copy of the terms and conditions which applied when you bought the holiday. They do not send that to you, rather the booking confirmation has a hyperlink to their web page which they can and have updated. They have already amended the Terms and Conditions with a statement about Covid-19 which clearly did not apply if you bought the holiday back in October like I did. In my opinion, changes to their Ts & Cs should be dated so that you can see clearly what was in place when you entered into contract - but they are all playing the game now.
This is my understanding at least. If you think you may resort to this, I would take a copy of those terms and conditions now, if you didn't already grab a copy..

I had a holiday booked via love holidays, we were supposed to fly out 6th may so it has been cancelled, I tried to change the booking to a date next may 2021, love holidays will only refund me the cost of the hotel saying that I have to get the refund of the flight from easy jet but I didn't book the flight direct with easy jet I paid in full love holidays, when I explained via the chat service that when I went to rebook they wanted a deposit that was much higher than the cost difference of the holiday next year I was told that I would have to pay it, the new holiday is £100 more which is fine but the deposit is £234 plus they would take off me each month £89 or if I want to just to pay a deposit now it would be £534. they wont listen to me saying that I booked via them for everything, easy jet wont pay me back the money it will go to love holidays, what can I do about this???

You can keep chasing them up if you want, also you if you paid via card can go another option (which type of card)

I guess this has answered my question pretty much. My friend booked through Love Holidays but she cancelled the DD before last payment of £700.00 came out. She was worried quite rightly that as we were flying 29th March it wouldn't be happening. I assume they will say that she has broken the contract she has had some contact with them and they have offered vouchers. Do you think that under the circumstances that would be the best thing to do.

I had a holiday booked with Love Holidays on 10 May to Corfu, it was ATOL protected
Rather than wait for a refund I changed the EasyJet flight to Croatia until September and through Love Holidays chose a hotel in Croatia.
i have not received a new ATOL certificate
Is the holiday still ATOL protected0
