    If they were travelling on the 2nd April, when was the final payment due? Surely would have been long before all this pandemic stuff started?

    Or do Love Holidays only ask for the final payment a fortnight before?

    But yes I agree, if the OP just stopped paying then they waive all rights.
  • Hi there, We contacted loveholiday as the payment was due out on the 18th March so they said they would defer payment so payment would be taken on the 24th March which by then they were advised by WHO that travel would not be happening so money was never taken, so we did not cancel the holiday ourselves.

    Most of the places I use expect final payment 2-3 months in advance, which is why I am hoping to clarify what OP meant by managing to stop the final payment. It doesn’t seem clear cut either way does it?

    But you said this in your opening post...

    "Luckily we were able to stop the final payment coming out"

    So which is it? You stopped a payment or did Love Holidays just not take the payment?

    So the line "Luckily we were able to stop the final payment coming out" isnt entirely true then?

    You may think this is all pedantry but it all matters.

    If you stopped the payment then you effectively cancelled the holiday and are only due back whatever part, if any, the original T and Cs say you would be due on cancellation. Unfortunately to have legal rights to a full refund you would need to have paid in full and waited for company to cancel.

    We didn't stop it though. They just never took the rest of the money out.

    You need to be very clear about this and about what happened, To quote bradders post above “ But you said this in your opening post

    So what were the exact circumstances that the final payment was not made, did you offer to make payment and it was declined, or did you just expect them to take the payment? If you were expecting them to just take payment what did you do when you noticed it wasn’t taken, what email trail have you got to show you tried to pay or made enquiries about it?

    I’m not familiar at all with the company so perhaps someone else might care to respond, I just know that when I use an agent of any sort I have always been expected to make payment myself or I forfeit the holiday, my usual agent I use for a specialist holiday phones or emails to remind me and I have to confirm that I give permission for the balance to be taken from the same card.
