    You'd be better off doing 3 x without a hearing @ £100 than less than 3 @ £255 each.

Not a fan of without hearing applications unless consented but better to try and clear the lot than half a job.
Thanks Henrik for the idea, so if I tick on the form without hearing I can simply attach a cheque for £100 and list all 3 ccjs from the same carpark company? That sounds like a good idea. What is the down side without hearing v hearing?
No. The courts have already told you they want paid 3 times to do this. 3 x £100.

    1 application per ccj.
Hi Henrik, Yes but at this stage I cannot throw money like this, I would be happy to do 1 ccj at a time £100 then if it works then submit a second application and enclose £100 and third etc.. because I currently am out of employment.  What do you think? 1 at a time
If the court agrees on all 3 that your cpr 13.2 argument is correct it is fine. (though very slow)

However, on the 2nd and 3rd you are effectively giving away any chance under cpr 13.3, should cpr 13.2 fail, as there is a requirement for the court to consider whether you acted promptly under 13.3 but not 13.2.

I'm not in favour of without a hearing or doing them individually, but if it's all you have it's all you have.
They were informed and they've decided. Still a good chance on service with an articulate argument.
  • Hi all,

Apologies, I am new to this thread. I'm looking for some advice re a CCJ.

I received a claim form from the county court business centre on the 16th of March regarding an unpaid PCN. I initially refuted the ticket (dated 31st Oct 2019) as I had paid a fare to park in the car park but I overstayed (I'm not sure exactly how long), max 1 hour due to teaching commitments.

I left the address where the letters had been sent to until just yesterday. I opened up a letter dated the 18th of August saying I have one month to pay the sum of £197 within one month that the judgement was granted by the court. However I've been away from this address for the last 5 or so months and am only seeing this now.

Any help on this matter would be greatly appreciated.

    Thanks very much.

No, this is not your thread. You knew when signing yup that youre not allowed to hijack someones thread with your problem - imagine how rude that would be in person!

You need to read the newbies thread, go back to page ONE of the forum, and start a new thread if one is needed.
So youre saying you did not make any arrangements to pick up post for 6 months?

    Hi,
I want to get them set aside as I am wanting to look for a mortgage and these will ruin my opportunity. The total value of all the ccjs are under £800. I have called dcbl and they said they sent me 4 letters for final notice of debt recovery, 1 letter for referral for enforcement from a ccj in 2020 which is already on my credit file. 1 referral for enforcement letter for a ccj on my credit file in 2020.

So now I am asking why should I pay dcbl for a ccjs from 2015 by uk parking control limited, one ccj contravention in 2019,

Can anyone help what I can do? As I said I now have 4 ccjs on my credit file, I do not wish dcbl to put any more ccjs on my credit file, thank you

I had discovered last year that I have 4 ccjs to my name
Did you not apply to have them set aside when you discovered them?

I had discovered last year that I have 4 ccjs to my name, 3 of those were from excel parking put in 2019 and 2 in 2020 for overstaying in supermarket carparks.
That seems to be 5 to me.

    1. Is it DCB Limited or DCB Legal writing to you?
    2. Who are they acting on behalf of?
    3. Can you upload a redacted photo/scan of the letter you've received, otherwise we are guessing at what you have in front of you?

DCBL are writing to me not DCB Legal, the last letter I received from them was on 5th May 2021 final notive of debt recovery, It said I failed to pay DCBL outstanding balance of £160 they will not recommend their client to take legal action against me.
Well that doesn't look like a CCJ recovery letter, more a bog-standard debt collector letter for an unpaid parking charge that has gone nowhere near a court.  Can you clarify which are actually CCJs - County Court Judgments?

I am a little bit scared to upload my letters on here because I read the people who work at these private companies also visit these forums
It is a bit late to be worrying about that if they have already taken you to court and a judgment has ben issued.  We only recommend not to put personal info on here if there is a chance you might identify a driver if you are defending as keeper - but it has gone way beyond that.

The enforcement letter is important because that might well be the heralding of a knock on your door at crack of dawn. But unless we can view the letter, we are guessing, and that can't be of any use to you at what could be a critical point.
