Case dismissed in the first 6 minutes.
Congratulations, you might want to put a report into the Southend echo https://www.echo-news.co.uk/ , perhaps the PPC at the airport could take a long walk off the pier

A brief summary:
VCS arrived late. The judge was just about to strike the claim, but they just made it.
We (the defendant - owner keeper, myself as driver -witness 1), barely had to speak.
The judge jumped straight to one of the photo's in their witness statement and asked them to explain it and in addition, exactly where it was within the airport complex. VCS immediately started to apologise. and then stated the incorrect area (I assume that VCS hadn't read my defence statement thoroughly). This is the same picture as I mentioned above and they hung themselves with their own statement
The judge then made comment to our substantial defence and witness statements and asked VCS if they wanted to proceed any further. VCS also agreed that my statement was substantial.
At this point the claim was dismissed.

Did the judge award you any costs? If not, read this

I like this ...

"Fools rush in"
And you said .....
They have clearly doctored and enhanced two key photos within their witness statement. As a keen photographer I can prove this.
This must be reported to the DVLA
UKPC got banned from the DVLA for doctoring pictures.

The judge referred to a specific paragraph in VCS's witness statement, three times. "This paragraph gives me a problem".
So, this related to VCS has a responsibility to confirm that a contravention had taken place prior to issuing a ticket/claim. They clearly didn't. They were winging it on something outside of their own rules. The judge picked on a photo which was the less damning. I could see VCS squirming in an instant, hence the apologetic response.3 -
And finally, thankyou to the people on this site and thread that have helped along the way, particularly with forming the initial defence and understanding the order of the court. I've learnt alot, but it's a drawn out process (over a year from start to finish). Anxious times along the way for an engineer that only sees black and white versus the legal world.
If "newbies" come on, please help them. The bottom line, and in hindsight, is easy, but help is needed to get there!3 -
If "newbies" come on, please help them. The bottom line, and in hindsight, is easy, but help is needed to get there! You're welcome to join us, no membership fee, nor exam to pass! In fact you have more personal, first-hand experience of the process than 90% of regulars who come here each day to advise the scammed, the naive and the vulnerable. Most of us have never suffered a PCN. It's a brilliant way to get back at the PPC which hounded you, as well as the wider PPC network, and can be extremely satisfying knowing you have helped a fellow human being, who, without help, is likely to fall prey to venal and rapacious predators. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
