There was a suggested response posted in the past couple of days, use that as yours too if everything else 'fits'. You need to get this in some proportion, the chances of this getting to court are remote. There is no 'cross examination' in a small claims court (although some c0cky advocates try it on); it's about an alleged small debt, not a murder case.Hazy05 said:Yes. Iv been reading them and will go back and re read now i have recieved this response from them. Do i have to reply back with the details or can i just produce them in court?
TIAThey are trying every which way to get a driver ID as they can't pursue the RK, and they know it!Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

A new wheeze by DCBL. Cross examined in a small claims court ....... They have been watching too much Perry Mason.Hazy05 said:Hi. Just an update of whats happening... I have now recieved a response back from DCBL.. They are saying they agree that someone who had access to my car have incured the parking cost.. They want to know who has access to my car and why?. If i fail to reply this will be brought up in court when i am cross examined and i could be in content of court. Also in bold letters underneath " cannot pay take it away" along with their payment details. How do i response to this. TIA
It's like we have all watched the total rubbish "can't pay, we'll take it away" on TV
THIS IS WHAT HAPPENED TO CHANEL 5Channel 5 pay damages to mother who was filmed being evicted from her home on Can’t Pay? We’ll Take it Away after privacy row

CROSS EXAMINATION ..... You can be your own Perry Mason and you'll be asking for their legal authority to add the fake amount and who signed the statement of truth WHICH IS NOT TRUE2 -
Thanks. I did think gavel and wigs or small room and table? 😏0

I seem to remember on here that a solicitor (no longer a solicitor) turned up in fancy dress just like a barrister.Hazy05 said:Thanks. I did think gavel and wigs or small room and table? 😏
The county court judge blasted him and told him to never enter his court again dressed like a fool
Not sure if they have a gavel but they do have a cane to spank those who bring dodgy claims2 -
Bet that was a sight to see😄0

What do you mean? There is NO OBLIGATION on you to say who was driving several years ago, even if you knew.
This is a private firm who have chosen never to use the POFA, therefore they are desperate to frighten Defendants into saying who was driving or feeling like they have to produce their insurance. You do not! You are not liable and have no such obligation, as Lead Adjudicator, barrister and UK private and public parking law expert, Henry Greenslade said in the POPLA annual report 2015. You know, the report that everyone is told to produce as an exhibit at WS stage for these non-POFA claims by Highview and CP Plus.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
