    Well i like to be organised. And i dont exactly know what im doing hence me lookiing over the other claims and reading the examples of others. I think you get more determined when you see how much they incease the fine!! Thats my hard earned cash they want, i dont think so. Im very nervous but im going to put my side across just as much they want to put theirs.🙂

    You don't "mail it to them" you send your defence to the e-mail address given in the defence template to the CCBC, who then send it to the claimant.

    Hi. I am planning taking photographs of the carpark one inc the entrance and the other i used to get to the shopping area. Can i just clarify i dont attach these to my defence as yet reading one of the posts it says this can be used later?  Sorry if its been repeated im just double checking im doing this right.

    Hi
    I am sending over my defence on Monday. I have posted it for critique. I feel i should be including more iv read lots of different defence appeals on here. Iv been and taken photographs from various angles its now increased to £ 100 charge ( mine was £85) There was also a billboard above the parking notice when i got mine ( think it was the Asda) that's no longer there and the sign is situated in the middle of a bush ( taken pictures for evidence). Do i use all this evidence in my witness statement. I am also trying to find the landowner two names have come up but not heard anything back as yet.

    .1.       The Defendant denies that the Claimant is entitled to relief in the sum claimed, or at all.  It is denied that a contract was entered into - by conduct or otherwise - whereby it was ‘agreed’ to pay a ‘parking charge’ and it is denied that this Claimant (understood to have a bare licence as managers) has standing to sue, nor to form contracts in their own name at the location.

    2.       It is admitted that the Defendant was the registered keeper of the vehicle in question on 14/05/2016. But liability is denied. It is not known who was the driver on 14/05/2016. Both the defendant and her husband have shared use of the car and neither can remember who was driving on this unremarkable day 5 years ago

    3 The Defendant was issued with a Claim Form by DCB legal acting on behalf of the Claimant Highview Parking Limited for a total of £291.47 ( inclusive of £25 court fee & £50 legal representatives costs). Previous letters from DCB have indicated it relates to PCN that was issued against the Defendant’s vehicle XXX XXX nearly 5 years ago on 14/05/2016 at Bradfield Road Car Park.

    As well as the defendant and her husband, do any other family members or friends have access to the car that could have been driving on the day in question with permission? If so, include that in your para 2.

    No evidence goes with the defence. All evidence is included at the Exhibits and WS stage which comes a few weeks before the hearing date.

    Yes actually both my sons was insured to drive my car. Ok, well iv drafted some of the evidence already. Iv also made a complaint to my MP. This carpark has been featured in our local newspaper numerous times.🙄
