DCBL certificated bailiffs and high court enforcements

Hi. I know you have spoken about these in previous threads and was last year. Basically I stayed 15mins over a 2 hour time slot this was in 2016. I ignored the letters sent back then. Anyway I moved house a year ago came home today to find a letter from this company now wanting £155.00!!!. It has the channel 5 series can't pay we will take it away logo hence me feeling a little threatened worried about the said bailiffs knocking on my door like the programme shows. Showed it to my son who is pretty clued up and said ignore it or if your really worried pay it!!!:(. He said he wouldn't. Just wondering how far it's gone before they actually was summoned to court if at all??? TIA

I supect on the back of the letter it says: "This case is not subject to High Court or bailiff action"

In which case these muppets are just acting as powerless debt collectors and can be ignored.

Dozens of these old claims have been handed over to dcbl to trade off their infamy on the awful Chanel 5 programme.

They just hope it frightens people into thinking their debt collecting dimwits operate in the same way.....they can't.

They won't be knocking on your door with a TV crew believe me, come back if you get real court papers from MCOL.

In the meantime have a read of the newbies thread near the top of this forum.

Those cases on TV were for more than £600 and you would have heard and seen them serving a writ from the High Court , plus it had already been to county court in the first place

The claimant has 6 years to issue a court claim via the CCBC in Northampton

So you need to email the DPO of the parking firm and tell them to erase your old address, and tell them that the new address that DCBL have traced you to, is your only address for service in 2020.

Also send a copy to DCBL but Brown Trout tells us they ignore these address data rectification notices (in which case, report them to the ICO).

You need to know for sure, and be confident that any claim comes to your actual address, so you can see it and defend it with our help, and win.

The very worst scenario is assuming, because they have your new address, that you trust them to use it for the claim! Because in fact PPCs do the opposite, deliberately getting secret CCJs for silly amounts of money they know the victim will discover too late to defend, because they KNOW they've used an old address.

Don't be that person, get the old address 'erased' (GDPR word, use it).

You know how to find any PPC's DPO and what the acronyms mean, from the NEWBIES thread info in the 2nd post of that sticky, about getting a SAR and data privacy.

Oh, and get a SAR from the DPO as well, while you are about it.

Hi I am just posting on here as I have now recieved a Pre_ Enforcement letter which states I have failed to pay the outstanding amount £155.00 they are now recommending their client to commence legay recovery action. Which they give a list of ways. Including an attachment of earnings,  charging order on my property,  prevent future lending, and removing goods by applying for a writ or warrant...... mmmmm I'm getting a little nervous now they are asking for immediate payment of this which I still think is wrong. On the back of the letter it states this  case is NOT subject to high court and Baliiff action ??

    TIA. Hazel

    UPDATE... 16.05.22🙂

Recieved an email this morning from DCBL instructing  their clients are discontinuing the court claim therefore the case is now closed. I was due to the court hearing on June 3rd.... Massive thanks for all your advice yes its been a little stressful at times especially coping with the loss of my mum. But it made me more determined and i felt more confident having the advice from everyone one here. Thanks a million🙂

Why the question marks?  This is normal and you know you will get a court claim.
The NEWBIES thread tells you what to do at each stage, as long as you already did what I advised above, to erase the old address.

You can't ignore these letters to your new address and just assume they will use that address for the claim.  You need to respond, deny the debt, confirm which address needs to be 'erased' and which is your actual address for service of the court claim.  And you need to email a SAR to the parking firm's DPO as well, as per the advice already here.

You need to re-read the NEWBIES thread 2nd post, if you don't know what to do at LBC stage.

No time given to pay. Just respond I  24 hours with phone number and to quote reference number. I think the original amount was 60.00. It's from 4 years ago so not 100% and I threw my last letter from them in the bin. I havent responded to any of the letters just letting it ride out. I'm prepared to go to court if need be. I needed to repost on here just for reassurance really just when you see the threats of removing my goods etc does slightly make you a bit wary. How do they get away with it?
