This is not where it ends!"
You have more to do after the defence
Read the newbies thread so you know the next steps, and what to do if, for example, the DQ doesnt arrive.3 -
UPDATE: Received CCBC letter recently, responded with a defence by post and got another letter with an acknowledge receipt of my defence and an information that the claimant now has 28 days to contact the court if they want to proceed. So I assume I must now wait until I hear further from the court, is that right? One question regarding this document: what does it mean that after the 28 days period has elapsed the claim will be "stayed"? Will it be just put on hold? What is the actual effect of claim being stayed? Many thanks in advance for any info.0

Why not just follow the guidance given in the second post of the NEWBIES thread.
You are now simply asking for that information to be rewritten for you personally on your own thread.
Again, read the NEWBIES thread.3 -
I have read NEWBIES thread and found nothing as an answer to my question (about claim being stayed). I did not receive a DQ yet so I assume I need to wait for it and, if not delivered within a week, check with the court. But when I read the letter from CCBC, they do not even mention a single word about DQ and instead, inform me that the copy of my defence has been served to a claimant and they may contact me directly and attempt to resolve the dispute. And if it cannot be resolved informally the claimant should decide what they want to do next and inform the court about their decision. So I anticipate that even if the court did not mention about any action I must take, I should contact them after a week and ask for DQ, is that correct?KeithP said:Why not just follow the guidance given in the second post of the NEWBIES thread. You are now simply asking for that information to be rewritten for you personally on your own thread.Again, read the NEWBIES thread.

Look again at that thread where you found the Defence template.
The first post on that thread explains all about what you need to do after filing a Defence.
There may well be nothing about a claim being stayed in the NEWBIES thread. That's because it is not a usual action. Doesn't the letter from the CCBC say that is only likely to happen if after 28 days there has been no response from the Claimant? Stick those bold words into google for an in depth explanation if you are really interested.
As for 'assuming you now wait' - I suggest you go back to the second post of the NEWBIES thread and read Bargepole's 'what happens when' post linked from there. You might consider getting ahead of yourself here by preparing for the next thing that is going to happen - you will receive your very own Directions Questionnaire to complete and return.

The claim won't be stayed but the term is easy enough to understand. This is all standard stuff.
What defence did you put in, I am concerned that you went off-piste because you didn't email it, you posted it, and that's not following our advice. So, did you use the template defence thread and adapt that?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:

Then either read it again or try google. The answer to almost question you ask can be found on the WWW.You never know how far you can go until you go too far.0 -

So, did you use the template defence thread and adapt that?Yes I did use the template defence and adapt it. For safety reason I have sent you some information via direct message. I have also filled in a DQ form but only the one I downloaded from gov's website because I haven't received one from CCBC yet.
I'm not 100% sure whether to send a DQ form to CCBC and claimant although I have not yet been asked to do so, therefore, I would like to get a confirmation like "YES" (meaning I must file a DQ form and it does not matter that I have not been asked by CCBC to do so), or "NO" (meaning that I should wait for a DQ form sent by CCBC and then file it to CCBC and claimant), or "CHECK" (which means that because I haven't yet received a DQ form within a week or two I should contact CCBC and ask them if they request me to file a DQ). I'm only asking for that confirmation because it is not fully clear for me what is the right option (after reading NEWBIES and Defence Template threads a numerous times - maybe it's all about my poor language skills?) and, because the last letter from CCBC suggests that "the claimant may contact you directly to attempt to resolve this case but they must contact CCBC within 28 days if they wish to proceed and CCBC will inform you of what will happen next" which I understand as "wait for our letter/phone-call/whatever-else and we shall inform you about any further steps you will be required to take".
An additional question - is it worth to raise at the hearing stage that PCN falsly states "no ticket" although the ticket is clearly visible on the photo taken by the parking operative (flipped over but still with a readable serial number)? In PPC's response to my appeal I can read: " there is what looks like the ticket face down on the photo".1 -
Show us the defence you posted, and if it is the template, obviously only show us the bits you changed.
Dont post stuff! Email.
Has the CCBC said, using MCOL, that a DQ has been sent to you? If no, then of course you do not yet send in a DQ.
You use MCOL, like everyone does, to know when to send the DQ
"no ticket" that they could read. Minor point.2 -
My defence is here (with all edits suggested by Le_Kirk; I've only changed para 2 and 3 of the Defence Template leaving the rest intact): https://forums.moneysavingexpert.com/discussion/comment/78031941/#Comment_78031941nosferatu1001 said:Show us the defence you posted, and if it is the template, obviously only show us the bits you changed.

"no ticket" that they could read. Minor point.Used MCOL website (thanks for pointing to it) and it says literally nothing about the DQ. It does only confirm that AoS has been submitted and defence received. No option to submitting anything. Now I clearly understand that I should wait for CCBC's or claimant's move, checking on MCOL once a week if there's any update to the claim which I wasn't notified about. Many thanks!1
