    Show us yoru properly formatted para 2 and 3, incorporating the info above. 
    Because you realise the template defence has tons more defnece points in it as well?
  • Sounds fine as your added point #3 and you have all the other defence points you need in the template defence you are adding that short bit to.

    You do know NOT to just write that ALONE(!!) and not to put it in on MCOL or on the paperwork?  If you don't, read the advice from KeithP again.

I see nothing else than my appeal to PPC and IAS response. Shouldn't they have to provide more in SAR? Signage T&C photos, windscreen and/or reg plate photos in example? Or it's just enough what I've got? I shall show my formatted para 2 and 3 asap, once I've edited it to suit my needs.

    The NEWBIE sticky explains why you do not submit a defence on MCOL, mainly because it will not fit in the miniscule defence box.  If you put so much as a full stop in there, it is taken as your defence.

    Do exactly what you are told to do. You're here for advice, the advice is to use the enwbies thread. This is basic process and we know basic process. 
    You know what a SAR is? It is a request for your personal data. WHy is a signage your personal data?

    It is not a case that you cannot raise the above on MCOL, it is that you would be daft to do it instead of following the tried and tested process on here, and follow the guide to court from the NEWBIES. It even has screenshots of what to do and when.

    They should have supplied a copy of the NTK, any photos of the vehicle containing the VRM or other unique identifiers, reminders, any documents you believe they have sent or should have sent. It doesn't matter if they have sent you stuff before, an SAR response must include all documents and images that contain your personal data.
    If they haven't complain and give them seven days to comply otherwise you will complain to the ICO. If they don't complain, then send the complaint.
    As others have said, I'm not sure why you think images of their signage would contain your data. The S in SAR is the Subject, who in this instance is you. All the scammers have to provide is personal data about you.

    Here's my para 2 and 3:

    2. It is admitted that the Defendant was the registered keeper and driver of the vehicle but liability is denied.
    3. The Defendant purchased, and still has in their possession, a valid parking ticket for the period the vehicle in question was parked at the location. Given the non-adhesive nature of the ticket, it could not be securely fixed to the window, therefore the defendant placed the ticket correctly on the dashboard. The defendant has no knowledge of when or how the ticket was flipped upside down. The Defendant has used the car park on the date specified as usual - parked correctly within the designated place, took a ticket from ticket machine and placed it onto the dashboard faced up correctly (the Defendant has assured himself that the registration number, valid date and time and the correct amount is clearly visible), then closed the door and went to work. After couple of hours, still within the paid period, he got back to the car park and found a PCN attached to the windscreen, which stated "no ticket" as a reason of issuing. Defendant has discovered that the ticket is still visible behind the windscreen with a readable serial number printed on it, but laying on dashboard upside down (not in the way it has been left by the Defendant). Taking into account that it must have been a mistake of an officer stating that there was no ticket, the Defendant has sent a (PARKING COMPANY) a photocopy of the front side of ticket, whose serial number clearly matches both sides, but this appeal has been rejected.

    I would really appreciate if someone would have checked this and say if it's correct.

  • Superb! For now I've got a suggested template's first page edited (whoa! 3 out of 18 paras!) and I am trying to understand what is the rest of information about. And I found that some portion of the document does not fit to my case. Can I just delete them or, must not delete any single para and should only edit all of them to fit to my case? Another question is related to SAR request - I requested, among others, all photos taken and PDT machine record, but actually got nothing (apart from NTD and my appeals with answers). Does it mean they won't use the photos of my car (with visible reg plates) as an evidence in the Court? Or they simply do not need to use them as of my statement of being a driver? Should I attach the photo of my car taken by them + ticket scans + PCN scan to my defence response, or just send the bare defence form? Thank you in advance for all your help - it's a lot to do, but way more to understand!
