BW LEGAL pre CCJ letter

Hi,
I hope you dont mind me creating a new thread here, I have read the newbie post but I am still unsure if I am ment to reply to correspondence or not.

To be honest (and I know this sounds terrible) but the debt is for 2 parking fines (premier parking) that I dont even remember where. One in April 2018 and one in may 2018 (More than likely an over stayed visit in a supermarket whilst shopping and breastfeeding my baby 🙄 )

Now I haven't responded to any of their letters but I have just now received a letter (dated 8th nov) saying I have until 13th dec to pay the outstanding £300 otherwise they are " instructed to issue a CCC without further reference" to myself.

Should I contact them now or should I leave it guys?

    Welcome! But...yet again we need to check which scammer a newbie means:

    Premier Park Ltd?
    Premier Parking Solutions Ltd?

    You just have a BW Legal Letter of Claim. The NEWBIES thread covers this stage and by getting a SAR from the parking firm you will get to see all the letters and photos they hold, then you can make a loud complaint to the Retail Park or Supermarket Management at a busy time of day when you get the 'evidence' data, and get them to cancel these before a claim arrives.

    Please tell us how they breakdown the £300 ?

    It is premier park Ltd.
    The costs are broken down as follows
    Principal debt £300
    Estimated interest £24.64
    Estimated court fees £25
    Estimated solicitors costs £50
    Total £399.64

    Sorry if I never read the post properly.
    Lack of time, sleep and sanity are major factors ��

  • I have 2 tickets one on the 25 April 2018 and one on the 12th may 2018 both have a £100 fee. So where they get the principal debt at £300 I dont know.. I am so confused.
    So I need to contact premier park Ltd for A SAR?

    Send them an SAR as per the advice in the NEWBIES and include proof of ID such as a copy of the vehicle V5.

    That should flush out the two PCNs that should have arrived shortly after the alleged event. You will then be able to complain to the landowner and also know why the charges were issued.
    If it is for an alleged overstay, then you mention the EA 2010 as breastfeeding mothers have protected characteristics in accordance with the act and should allow extra time once they are made aware of this.

    They are not fines, and it is not a pre CCJ letter, unless you ignore everything in which case it could become one.

    Have you moved house since then, and if so did you update your V5 and Driving Licence with the DVLA, or did you receive the NTKs but ignored them?

    I appreciate you have a life to live but don't take your eye off the ball with this. Questions we ask are to help you and you must respond to a letter of claim
    Have you done what coupon-mad said above ??

    THERE IS NO PRINCIPAL DEBT FOR £300 when two tickets amount to £200. IT'S THE BWLEGAL SCAM

    You must tell them that the principal debt they claim is £200 and not £300. How do they explain the extra £100 ?

    Even if a scammer does take you to court and win. the most a judge is likely to award is unlikely to exceed £200, anything above that is almost certainly unlawful and a judge might well consider the whole claim ultra vires, read this

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    So I went back and re-read the newbies thread about the sar...
    So I use the message template, send them his SAR with all the relevant info .. (it says I have until the 13thdec to pay, will the automatically put on hold or will I need to request that to them.. also,
    The part you said about the money, do I put that on the SAR or is that separate thing?
