I hope everyone is well and keeping themselves safe during this difficult time. I wanted to provide an update on the IAS cases and the outcome of appeals. IAS can be hit and miss, however, I had some success with the appeals I logged.- 13 appeals allowed
- 5 waiting adjudication
- 6 dismissed
The allowed appeals were based on the initial template but with some additional tweaks. I completely understand that the IAS is a waste of time in most cases, however, its worth noting that the appeals allowed were conceded by UKCPS and I have no issue sharing my appeal summary below I uploaded to the IAS portal.
This summary below was added as a response to the operator's case, it may not apply to your case, so please do not copy and paste blindly.
The operator is pursuing the driver as their correspondence clearly states. They did not issue a notice to keeper, the notice they issued is Non-POFA meaning it is not a notice to keeper and does not state that they are transfering liability to the keeper. Therefore the keeper is not liable and the appeal must be allowed. The adjudicator is not allowed to state their opinion and make assumptions on behalf of the operator. The operator has not complied with the requirements of POFA 2012 and therefore there is no liability on the keeper. I hope the trained legal professional assessing this case applies the law of contract correctly. The operator has a contract with the driver and no liability can be transfered to the keeper. I have also attached the appeal letter for reference.

Very good news, well worth people trying IAS then for these UKCPS no stopping cases but I share your wanring that the above was not the appeal, but was the response to evidence. The main IAS appeal would need photo evidence that the signage was diabolical for starters, which I expect you did.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I got a parking charge form UKCPS for driving up the approach behind Gateway Hs Piccadilly Manchester. I was picking someone up from the station. It was 23.30hrs and having not been to Piccadilly station for 30 years in a car,I thought there was still parking at the back. Having got to the top, I did a U turn and asked someone where the pick up area was. I then rang my friend to sort of tell them where i was. Ihad pulled up nr the back of a hotel for all of 4 minutes. I explained all this and thay Im a disabled driver and basically was lost at near midnight, but they replied saying if I wasnt the driver who was and to inform them. I was confused as I had explained it was my car and I was driving so sent another letter directly early January. Anyhow with all this Covid I forgot about it until today when a debt collection company sent me a letter and bill for £160. They say UKCPS received both my letters and they sent me another in May which I haven't received. What should I do. I'm registered disabled and dont have a job. Do I pay in instalments or go to court? Thank you0 -

The fourth post of the sticky thread for NEWBIES that asks you to read it before you post tells you this, and explains why it is safe to ignore toothless debt collectors.
Nobody but nobody will tell you to pay a bunch of unregulated scammers, and I am disappointed that you are even considering doing so.
You would be better throwing your money down a drain because at least then the scammers wouldn't be able to use it and fund more scams.
If you get a court claim in the next six years then start your own thread.
Meanwhile get pics of the site and signage either by visiting the site or by thoroughly reading all posts of this thread.
Don't forget to make the all important complaint to your MP.
By the way, this country does not have a register of disabled people so you cannot be on one.

No paying. OF COURSE you don't offer to pay! It is a scam. Have you read the whole thread?

I've now had a response from The Chief Exec of Manchester City Council. She says...
"My understanding is that the Act made no provision for local authorities to have a say in these matters, and therefore I am unable to assist further with this case"
She goes on to say "Citizens Advice Service provide two options for these circumstances.
The first is to allow the parking company to take the matter to court and defend the case accordingly, the second is to pay the outstanding balance and make a small claim to get the money back"
I've urged My MP to intervene.
Hopefully, this scam will be featured on Radio 4 after lockdown, they are interested in the story as a good example of what Parking companies are still getting away with.
Everyone here says 'keep complaining', but the DVLA and IAS are not interested, I've tried.
