Help, got until 24th November to submit Defence for VCS

Hello My Peeps!!  Have missed you guys, hope you're all well....

Here is my follow up letter to MP regarding the strike out:

"Dear Olivia

I hope you are well.

I write to give you an update on our court challenge to the VCS claim of £185 for parking at the Berkley Centre Tesco car park, on Ecclesall Road.

The case was struck out by Judge Rose in February 2021 (judgement attached). 

Judge Rose stated that companies were distinct legal persons and there is no signed agreement between the landowner and Excel to transfer duties to VCS. Judge Rose also said that sending out misleading documents had criminal consequences.

After he struck out the claim for no standing, Judge Rose asked me if I had anything further to add. I said only that this Claimant is a scourge on our local community with its attempts at double recovery. VCS know that they cannot lawfully ask for £185, but they also know that most people will pay, rather than go to court, which is effectively extortion.

Judge Rose said that he was well aware what was happening at this car park, but that it was not the arena for this discussion and I was to take it up with my MP. 

I said that I would do that.

I have copied in the landowner, Mr Greg Barraclough, so he is clear that VCS are acting unlawfully on his land.

Thanks for the suggestion DPD. Have phoned Trading Standards & they have taken details & will check regulations & criminal aspects. Will email local paper now!

They're chancers! Banking on the fact that most people will just pay, rather than face court. The thought of court is very frightening to many lay folk - & Renshaw-Smith absolutely capitalises on this. !!!!!!.

Does anyone one know the status of the private member's bill. Feels like we've been waiting for the law to catch up to these con-artists for YEARS!

There are a couple of threads about the progress of the bill/PAS. Some info about parts of it have been released, but not everything has been decided yet, but sadly it is not due to come into force until next year, and I doubt any of it can be applied retrospectively.

I suspect many scammers are frantically trying to hide white fivers under the mattress and look for legitimate ways of not paying tax on their legitimately obtained monies.
