Although your case isn't persuasive, it would help other victims to show what at least one other judge thinks about this data breach.
Think you may have mistaken me for someone else m'lud!!  :D

I'm glad you've come back to this thread because I also wanted to ask if I could quote your case and the judgment when helping other posters. It would be really useful to know the case number, *your name* v VCS, the date of the hearing, the judge's name, and the location of the court.

Yes that’s fine. Claim no: F8QZ16DT, David Doncaster Vs VCS, 4th February 2021, District Judge Rose, County Court at Sheffield.

VCS HAS NO STANDING TO BRING A CLAIM. There is no signed agreement between the landowner and Excel to transfer duties to VCS. “Striking out claim. Claimant has no standing”.

    Court strikes out claim.

Hi CM. Happy New Year!  :D

Hope you are well (and the whole crew)...

The lady you referenced above got in touch with me recently to ask how she could get rid of the CCJ she got for not attending her court case. She's trying to get a mortgage bless her! The only thing I could tell her was that they are automatically removed from credit records after 6 years. There's nothing else to add is there!

Not unless she wants to try a £303 N244 application quickly.  Ignoring a court claim means she doesn't have the greatest prospects of a Judge agreeing ... but if she attaches a decent draft defence and your court order about the same place, she COULD have grounds to say her case should be heard in the interests of justice.

She'd be relying on the Denton tests and VCS v Carr (Court of Appeal interim judgment) and her draft defence and your court judgment.

I'd do it if I was her but it's urgent ... she can't sit & think about it. MUST BE DONE 'PROMPTLY', SO NEXT WEEK IS GOOD!

Maybe you could attend her hearing with her, to set aside her CCJ?

    Happy New Year!
