At least the point was made about which entity is entitled to sue. That will now stick in that court area.
What cannot be understood is why the car park is covered with Excel signs and SRS decides that VCS should sue ? Is that plain ignorance or plain stupidity ... it's one or the other ? ,,, or both.
The article should be sent to all national newspapers for full exposure about this Rogue Trader

1. If VCS goes under, creditors cannot claim from Excel.
That would depend for how much and if the creditors could show foul play2 -
