    "16 Customer Communication
please read all the information we send you
16.1 We update our Customer Communication from time to time. Information on various topics is mailed to Customers with their monthly billing statements and is available on request from us. You are asked to read your Customer Communications and to keep those which are mailed to you until they are superseded. We regard you as having been given any information if it is either:
    a) included in a mailing addressed to you
    b) by voicemail, email text or other form of electronic message sent by us to your Device
    c) communicated directly by any means. "

But note the announcement on the bill only covered call forwarding numbers starting 07. They do not appear to have issued a notice to all contract users by mail, voicemail, e mail, or text saying 01/2 call through numbers will be charged, and its not yet mentioned in their T&C or their current price list. So if anyones charged to call a 01/02 call forwarding number they would appear to have grounds to challenge it.;)

That clause seems to me to be far too broad. A change to terms and conditions should be drawn to the customers attention in a clear and prominent manner. Tucking it at the bottom of page 1 of a bill which most people do not read or even glance at does not meet the criteria.

As someone said it is only certain numbers yet. If they extend it to 01/02 numbers then it may be worth challenging that change in court. It is possible if anyone is feeling sufficiently brave to challenge the 077 decision even now in court!!

If your going to read anything you think people would check their bill.:D Surely the fact that it appears on the bill covers them by .

Being included in a mailing addressed to customer.

Or if you dont consider a bill a mailing.

Being communicated directly by any means.
  • I've just checked my bills online and it's not mentioned anywhere on mine. Not that I call these numbers anyway. I honestly just want an excuse to get out of my contract and this sounds like my escape!

Every month I have 90per cent of my allowances left yet Orange charge me an extra 15-20 pounds. It's utterly bizarre. Funnily enough they stopped once I called and my bill is now back to 30 pounds.
  • did you use to text or call number outside your allowance??

Virgin treat all 01/02 geographical numbers the same wherever they are connected to.;) So if you have inclusive minutes they are included.

I have yet to see any hard evidence yet that Orange are charging to call 01/02 access numbers. Has anyone had a bill where they have been charged ? Their T&C does not mention it.

    The original email is:-

    Customer Relations,

    Darlington,
    County Durham,
    DL1 4YB

    Account Number: - XXXX
    Phone numbers:- XXXX
    Date 02/01/2008
    Dear Sirs
I have recently received a notification from yourselves stating that the following numbers beginning with 079730 078225 079785 07873 070 will now become chargeable instead of being deducted from inclusive minutes. In accordance with section 4.3 of your terms and condition this clearly warrants a breech of contract. For your convenience I have listed the clause below.

"Terminating your Contract because Orange has changed its terms You may also terminate your Contract if we vary its terms, resulting in an excessive increase in the Charges or changes that alter your rights under this Contract to your detriment. In such cases you would need to give us at least 14 days written notice prior to your Billing Date (and within one month of us telling you about the changes)."

I hereby give one months notice from the date of this letter after which I will cancel my direct debt and stop using the phone.

I would be obliged if you could confirm the cancellation of any contract, in writing as soon as possible. If you do not respond to this letter within the 30 day period I will assume that you accept this notification to cancel without penalties.

If you require any further information, please do not hesitate to contact me at the address below.

    Regards
    XXXX

I HOPE U WILL MANAGE TO NEGOTIATE WITH THEM ON UR TERMS..

PLZ DO LET US KNOW OF UR OUTCOMES ..
