it says a reasonable person. If the majority of people chosen are unreasonable then their opinion would be wrong.

However supermarkets do not make a decision based on what any reasonable person thinks. If i bring in a piece of fruit or veg all they can do is look at it and also take into account any history of refunds then make a decision on a whim. hardly rigorous is it. They will refund you solely based on your history. If its the first time they'll do it. Once you get to the 100th time they get suspicious. Thats not how the law works. The rules are unfairly applied to food products which are bought repeatedly, as opposed to one off items like tvs or fridges.

Actually you may find that that's exactly how the law works. If I ran a fruit & veg shop (I did work in one during my school holidays) and you had returned items 100 times, your custom would no longer be welcome. When it happens to you, try suing them to see how the law works.

What law says they can't stop you shopping there? They are perfectly free not allow you to shop with them end of.

So how do you avoid giving that impression? By refraining from returning things everytime youre sold a rotten piece of fruit or veg. How is that consumer rights?

Why did you buy a rotten piece of fruit or veg.? I've never chosen to buy a rotten piece of anything in my life.

OP, please give us all a laugh and tell us what things you have had a refund for and the reasons why you complained about the items.

Re. your other thread, you mention you got some compensation from the NHS.
It wasn't for the food was it? :)

If you go into a casino every day and you win every day you are entitled to that money. Even if it is suspicious.

Thats the way I look at this. I am not fussy I just expect the same high quality every time not just occasionally. If I buy it 100 times and its bad 100 times and it can be proven, then i am entitled to 100 refunds no matter how suspicious it is. The problem that is being ignored is there is no way to prove it one way or the other so it just gets decided on a whim. I would expect even more compensation if it kept happening. A ban is just the easy solution for them but its not justified. Can they ban you just for your age religion race or sexuality too if it doesnt suit them? Its no different is it?

Why dont you focus on all the things I've bought which i did not return? Theres far more of those than the returns. What about all the stuff thats gone in the bin because i wanted to avoid the humiliation of returning it and being refused? I bet supermarkets must be making huge profits on selling bad quality food that people end up throwing away. If you dont fight for your rights you'll lose them completely.

It is different yes and it is justifiable, they consider your returns excessive....you are free not to shop there and they are free to not let you either...works both ways and is fair.

You don't have the right to shop there...they can decide not to let you in their store as you can likewise choose not to shop there. Fair and equitable. Dry your eyes!

no it doesnt work both ways. I am forced to shop at the supermarkets theres no other way to buy such a large selection of food than going to the supermarkets. They can ban me because it has zero effect on their profits. My loss is far greater than their loss.

Nobody forces you to shop there FGS..it improves their profits to ban you as you return too much in their thinking...find another supermarket. Shop online...maybe the picker will do a better job choosing fresher fruit and veg. than you do?
