I know why the payments werent being made..Seems my dad didnt have enough money in his bank account. Quin-Direct (my insurance company) say that they sent several letters, none of which i or my family have seen. The only 1 i have is the one i recieved today, saying that it's a CONFIRMATION of cancillation.. Could I argue that I thought i was entitled to drive untill the confirmation came in?
You could argue that, but unfortunately it would not be fruitful. It is your responsibility to ensure that you are insured, not merely to assume that you are insured.
The only real concession that the Road Traffic Act makes in respect of being 'unaware' that you are uninsured is where you are driving an employer's car in the course of your employment and you neither know nor have reason to believe that you are uninsured. Clearly that does not apply here.
I'm also slightly confused when you say 'you' received the confirmation of cancellation. Surely if the policy was in your father's name then the letters would be addressed to him?0 -
Quinn will have sent a recorded delivery letter to you giving you notice the policy was to be cancelled. I'm guessing this is the letter you have just received or there will be a recorded delivery letter that someone at your home has not signed for so it was sent back.
If you ring Quinn you can ask them when they sent the letter and the tracking ref which you can put into the Post Office Website and finds out what happened to the letter.
Have you checked your dads bank statements to find when the payments were due and when and how many times they bounced0 -

I am sorry I was not clearer on this. When I got home, the mail man had already been to my door and put letters in. Amongst those was one from quinn direct addressed to my father. OBviously, having just been stopped by police and having my car seized, i opened it and thats when i saw the cancillation confirmation.0 -
When morning comes, I am going to phone Quinn and try see what has happened. Clearly as you say Nigel, at first sight it seems they have made a mistake by not giving me sufficient notice, and i hope this first sight is correct0

the police told me that the policy was cancelled on the 17th of june. thats 8 days prior to the police stopping me.. do you think...??:rolleyes:0 -
Quinn#s policy states they send a letter giving you 10 days notice,
Does the letter you received state something along the lines of "We hereby give you notice that the above policy will be cancelled in 10 days time, it is an offence under the Road Traffic Act to use a vehicle without insurance against third party liabilities"
Or is the letter you received a letter just stating the policy has been cancelled and that you owe them x amount of premium0 -
Now i know there has to be a price for cancelling, i didnt want to leave Tesco, but they couldnt find my car with the reg and they couldnt find it manually so i felt i had no choice but to go elsewhere, the 1st lady i spoke to said it would cost me about £69 but i would get £40 back from the breakdown cover, which i was fine with, then when i spoke to a different person, he said my actual amount to cancel would be £169 surely this cant be allowed?0
