    Nothing has changed.

That is not from DCBLegal.  It's from the HCEOs who want all the money, and some.

I contacted the court to make payment. They are asking for £14 instead £275?? Saying that the set aside and the writ costs £14. I didn’t had my card with me to make the payment, had my husbands. I couldn’t proceed the payment as he was with me at the time. She told me the application won’t look into today anyway, so advised me to call tomorrow at 9 am.

    Is it really £14?

As long as that box in your N244 said you want two things: a stay of execution of a writ AND a hearing to set aside the CCJ, then I say £275 is correct.

You are not applying for a writ you are applying to urgently stay a writ, plus set aside a CCJ.  That involves a hearing and is not cheap.

    Maybe the clerk misunderstood.

Tomorrow, you must not just pay the fee.  You must stay on the phone get their assurance and promise, that because you are vulnerable it is vital that a Judge deals with the stay Order this week to protect you.  DCBLtd already tried to add £200.

Also, tomorrow, forward a copy of your N244 to DCBLtd and DCBLegal (both) and tell them that the CCBC is ordering a stay and given your vulnerable position and the fact you have now applied to set aside the CCJ, you expect to hear nothing further from them (certainly nothing from High Court Enforcement) until the case is allocated to your local court.  And certainly no writ or enforcement should be pursued.

It may be a confusion as my subject is ‘urgent stay of execution of High court writ needed’.

I will call them tomorrow to discuss.

    Thank you.

Yes they probably just saw the email header but your N244 is also for a set aside hearing.

I made the payment. The lady was sure about the payment, If someone applying for set aside and stay of writ together in N244 then it's £14. If it's just set aside then it would be £275.

I called CCBC support service and cried (Didn't make up, I was/ am really worried and stressed). She told me they have not received the application and it can take 2-3 days. I asked if it is possible to fast track for me and explained that I am pregnant and all. But she can't do anything until she get the application form. Once received it can take upto 6 weeks for judge to make a decision.

She also told me it is likely to affect my credit records for 6 years if the judgement not set aside by 18/3/22 (today is the 15/3/22). Should I make the payment? Please advise :(

The judgement will stay on your records for 6 years, but it will be wiped as if it never existed if the set aside hearing is successful, resetting the clock so you can defend the original claim.

Paying the judgment by the deadline stops the CCJ from ever appearing. Paying it after the deadline means it will stay there for either six years or until a set-aside is successful.

I can't advise you which is the best option though.

These two statements do not compute!  Have you sent the application (N244 plus witness statement) to them by email and if so, I don't understand why the lady is saying it has not arrived.  Did you post it by Royal Mail?

Even if this is after the 18/3/22? What happens if the judge does not agree with set aside this case?  CCBC advisor told me it can be removed even I pay the amount after the 18/3/22 however this will be in my records as 'satisfied'. Does this affect me getting mortgage? :(
Arghhhh.... I am so stressed and cannot make a decision.
