I am going to win this case because of the permit and agreement that I have provided but I want to raise the above points to the judge so that he realises how dirty these mongrels are.
Judges are fickle. Some may just want you to shut up.
Do not lose focus of the main goal - winning.2 -
Thanks Coupon-Mad and Henrik777.
Henrik - yes I know, you're absolutely right. The judge hearing my case in fact was one that simply wanted to focus on the strongest point of argument. There were many points I had argued in my Defence but he wanted to just focus on the new evidence and ignored the rest.1 -
Hi everyone, I hope you are all doing well during these difficult times.
- My hearing was scheduled for next week but I received a letter from court a couple of days ago stating that the hearing is adjourned for another couple of months and will take place over the telephone. I am literally freaking out here. In my last hearing the judge hadn't bothered to read anything and just wanted to get it over and done with. A telephone hearing will be a disaster.
- The order I have received states that the parties are required to file an electronic bundle of documents and indicates that the matter will be heard remotely without access to the Court File.
- The order also states that if any party considers the matter not to be suitable for a remote hearing should email their objection and reasons to the court.
- My question is - on what grounds can I object this telephone hearing?

Follow that link and read all about telephone hearings and how you can object. There is an example hearing notice posted by Bargepole on 16th April at 11.04 pm, which give you some clue as to how you can object.6

Definitely opt against a phone hearing for this case

Agreed. £3,400 is too large a sum to be dealt with by telephone.BrownTrout said:Definitely opt against a phone hearing for this casePlease note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

The telephone hearings thread tells you on p10 what to put in your covering email and what grounds to use (maybe you have young children being supervised at home? if so, read the version I wrote for @Littlewadie ).
No to a telephone hearing, eeek!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

This may be helpful in seeking adjournment - a summary of the guidance issued to the courts (and a link to the full note).

A ppc working on the cheap is unlikely to pull together a comprehensive ebundle - done well it takes time to hyperlink, tab and paginate so you have a pdf that reads like a book.
This is complex, you're unrepresented - a litigant in person - and this is more likely to be a longer, document heavy hearing.4 -
In my opinion any PPC trying to claim this sort of money from a resident is asking for trouble. You never know how far you can go until you go too far.1
