    So the claimant being different to the alleged contract maker is still alive and number 1 argument ?

    Well you say you included everything so in that case this is a winning point, the claimant has no contract. Any contract is with another company. Any judicial decision which states otherwise is perverse. I cannot see how you can lose.

    Sorry guys, with all the distress I forgot to mention much earlier that the Claimant provided evidence in their bundle to show that the PPC was indeed the same in the photos too.

    So the evidence that I obtained at the very last minute (which the managing agent was reluctant to dig up for my BiL) was filed and served to the court and the claimant yesterday.

    Today the claimant asked the judge to disallow admittance of that evidence. The evidence comprised of a parking permit which covers my BiL for the whole period of the parking charges and there is a copy of the hundreds of pounds that he had paid for that permit for the relevant years. The building agents had not sent the permit to my BiL, despite my BiL endlessly chasing them, because the agent dealing with the permit was going through a difficult time in his personal life and was away for a while.

    The judge decided he would allow the evidence but adjourned the case so that the Claimant could defend against the new evidence. We have therefore been asked to return in 28 days. The Claimant asked the judge to award costs for his time today at £100. The judge asked me what I thought and I said it would be unfair and that I think costs should be left to the final decision at the next hearing. But he decided to allow the Claimant costs because he said that had we provided the evidence earlier there may have been no need to come to court - the issue may have been resolved out of court. So I have been asked to make that payment in 21 days.

    I had a few other points to argue, exclusive of the new evidence, but I read from his demeanour that he was not interested. I guess I have strong evidence and perhaps he wanted to only concentrate on that and not waste time on anything else.

    He did also make an order that I submit a Witness Statement made by my BiL and asked for another statement from me too.

    No, they didn't, I doubt it anyway. This is VITAL to check. You should be winning on that point alone and not paying them £100 costs for the wrong company bringing the case!

    So all the PCNs relate to the years 2015/16. I found out the signs were changed in 2018 and the PPC was changed as well - becoming Parking Ticketing Ltd. I did not know of the change and did not have any proof of the signs from 2015 so I assumed there was a discrepancy. Only after receiving their evidence did I check the PPC names on all the signs and realise that it was indeed Parking Ticketing Ltd.

    It cant have changed TO PTL if the signs in 2015 were also PTL....
