    Ok I will go. The Claimant has already mentioned in their second W/S about my second W/S. So that in itself is proof that it has been sent.

    In which case yes, the court must be informed. Letter and email.

    I think the Order itself is defective in not saying that this has been ordered of the court's own volition and any party affected by it normally has seven days (sometimes more) to respond. 

    We saw one properly worded by DJ Iyer this month where another court (Manchester I think) had lost someone's WS.

    Hi Coupon-mad, thank you for your response. So if the order is potentially defective, is there anything else I can do apart from letting them know there has been some sort of an error and submitting all relevant documents?

    You have to immediately make them aware that the WS was sent, providing proof etc. Refer to the claimant knowing about your WS as well.

    Just get on with the complaint, urgently, and follow it up within every 3-5 days until it's sorted.

  • Hello everyone. I hope you're all safe and well. 
    I finally received a letter from the Court and this is what it states:
    "In regard to your letter dated  xxxx it has been referred to a judge who states "the Defendant is entitled to apply to set aside the order dated xxxx (CPR3.3(5)) but must file the appropriate application notice and pay the appropriate Court Fee."
    The letter has been signed off by an Administrative Officer. 
    This seems so unjust. The court has made the error and yet I am to pay the fee for some application? 
    I would be quite grateful if someone would take the time to explain what is going on here and how I can defend myself.
