    Thanks for input so far.

    I have now received

    1. A Notice of Transfer of Proceedings to my local County Court Business Centre. Awaiting allocation. I had not previously given dates that I am unable to attend. Now suddenly I have a whole bunch of dates that would be really difficult for me. Is it permissible to lodge those dates with the Court? I will call them tomorrow.
    2. Disclosure requested on all data that One Parking Solutions hold on me.
    They have only sent data relating to this claim. Photos of my car with times - just over 11 minutes from arriving to leaving.

    I know that I have had dealings with One Parking Solutions previously, when I have called to book parking spaces with them at the Railway Station (they no longer manage that site). I want this information as it may help me in Court. Surely they should have supplied this? My request for disclosure clearly stated:
    [FONT=&quot]ALL data held including a note of times I entered and departed xxxx on xx xxxx 2019
    - ALL and any other data which you hold on me, relating to parking or any dealings that One Parking Solution has had with me, whatsoever they may be.[/FONT]

    Do you want help in court if you are local? I am doing an Eastgate Wharf one soon - attending with the victim - and have loads of info and ammo.

    Let me know if the Lewes forum finds evidence that there has to be 15 mins allowed before enforcement at that site - I seem to recall there was something about that in the contract a while back.

    Forget this, not relevant to this case:

    Send me a pm if you want help and let me know which is your local court. DO NOT phone them, just send a fresh DQ (download one today) to the Claimant and the local County Court Business Centre, with your new dates added, and put a covering letter with it saying that as the case is awaiting allocation you need to add in the dates shown on this DQ as you are unable to attend.

    Never tried that but try it!! No phone calls.

    Always add an extra date either side of any holiday of course, give yourself room.

    I suggested this to a poster in a similar position a few weeks back. Don't know the outcome as OP didn't respond ........... yet.
  • Coupon-mad and Le_Kirk thank you. I have now downloaded a fresh DQ form. My printer is broken. I am not working tomorrow so will go to the Library and print out a couple of copies. It will be interesting to see what the Eastgate Wharf outcome is Coupon-mad. I am trying to find out about the 15 minute rule. Thank you also for your kind offer of helping at court. Let's see what happens next and I shall get back to you.

    Yes they must disclose all data held, but maybe that data is no longer held, or if it is then you may have to ask for it specifically if you feel all they've done is supply data relating to this PCN and event only.

    You send a copy to the Claimant. The address to sent it is on your Claim Form - in the box entitled Address for sending documents and payments (if different).

    I have had a rethink re which Court I should be requesting. Does anyone have any experience of asking to change the Court which I first requested? The Judge has not yet allocated a date and I am about to print up new forms to send off with dates that I cannot now make. I could also request a different court at the same time.

  • I have now completed a new DQ and sent to the Court which I requested in the first place and requested that a different court be allocated. I have also sent a copy with a covering letter to OPS's solicitors. Whilst writing to the solicitors I have also requested that they remind their client, OPS to furnish me with the remainder of ALL data disclosure in relation myself and which I asked for a month ago.
    Finally off to print and post. I'll update here when I hear further.


    Coupon-mad, I would definitely appreciate help in court, if you are able and I believe that I am local to you.
    I'll PM to you when I am back from printing.

    Some good news.  I have just won my case with OPS and there is better news even than that.  More than I could have hoped for and an outcome which may assist others.  I advise anyone who is planning to challenge OPS, to be very careful not to identify yourself on here, as OPS and their debt collector ZZPS are on these forums, are watching and their practices are incidious. This is likely to apply to any parking company.  Don't show your hand.  Go to the Newbies thread and read the information there and then start your own thread for the help that you need.  **NEWBIES!!
