It was so good to have CM and PM there along with the retired barrister and my friend. The support was so reassuring. CM knows what she is talking about. If I had been on my own I would never have picked up on the half of it - including the untruths being given in evidence for the Claimant. Anyone who comes across the charming chap from LPC Law needs to be fully aware. He is aggressive. I was definitely thrown, firstly that I was cross examined and then with his tenacity, I would say bullying behaviour, in hammering me with the same questions and not accepting my answers. Afterwards I had to check with the 'girls' that I had in fact stuck to my guns - the truth. Luckily the aerial shot of the piece of land meant absolutely nothing to me and I told him so, but still he kept hammering. All will be revealed very shortly. The Judgement makes for a good read, it is full of interesting facts, well written, amusing and as CM said - dynamite.

Well done for beating a bully. sounds like a low grade american movie with this legal chappie .... all over a £100 ticket, so pathetic5

Guys and gals, would it be worth making a formal complaint about the LPC Law rep's behaviour?Surely the courts can't be seen to allow legal reps to act in a bullying manner towards witnesses or party(ies) in person? This LPC Law person seems to think everything is a criminal court case even when in civil claims track.6

Thats not behaviour that would have been allowed at criminal court either, from my limited experience (not in the dock!)7

Of course, there may have been other complaints, and this could be the final straw. Milk it for all it is worth. You never know how far you can go until you go too far.5 -

I am hoping that LPC has now caused, all by themselves, immense damage to the parking industry7 -
Your comments re the bully boy are well expressed. His behavioiur is mentioned in the Judgment, although he is not reprimanded and perhaps he should be - I finished copying, redacting my name and scanning last night and you will have it shortly. DDJ Harvey was, as noted, really unwell and was sneezing and looking very uncomfortable. It did definitely concern me that such behaviour was allowed. What actually concerned me more was that I was not allowed to then quiz the bully. But, I did wonder afterwards if the Judge was allowing the bully space to show his tactics. The aerial photo was definitely a total red herring and designed to confuse, if you ask me. I hope that LPC Law do take some heat. I also reckon that Ms Leering (variously referred to in the Judgment as Leering/Peering/Sheering) may be something of a fall guy here too. Anyhow, draw your own conclusions when you read the epic drama that is my Judgement. Justice has been done that is for sure. Will OPS/QDR appeal? There is always that chance, but they and others will have a significant few hurdles to jump to do so.7

I've been against LPC Law reps many times, and many of the seem to think they are on a career path to becoming a top flight barrister. The fact that they are in a small claims hearing arguing the toss over a piddling little parking charge somewhat undermines that perception.
Aggressive and bullying cross-examination of witnesses is a common trait, often accompanied with an air of sneering superiority. It sounds as if DDJ Harvey wasn't up to slapping down the buffoon on this occasion, but in one case I was involved in, where the LPC rep was badgering the witness, the Judge stepped in, and said 'Mr X, this isn't the Old Bailey, and the defendant is not on trial on a murder charge. Kindly moderate the tone of your questions accordingly, or I will bring this cross-examination to a close'.
When the claim was subsequently dismissed, the rep gathered up his laptop and papers with indecent haste, and shot out of the court building like his pants were on fire.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.12
