    Yep, and I would add:
    2. By nature of the day and time of which the PCN was issued, it is clear that the driver present was not acting or operating in business hours. A rest break taken on a journey in recreational time, where by a purchase was made in good faith, cannot be the responsibility of any usual associated business of the vehicle conducted in usual Monday – Friday, 8am – 6pm operation hours. Therefore, the keeper company cannot be held liable for the actions of the driver, neither under the POFA nor under the skewed interpretation of a 'sector expert' who wrongly wants POPLA Assessors to apply flawed logic, to assume that all drivers are acting on behalf of a company, even when the car was at a restaurant at night.

  • Ok. So I've amended as suggested. I've also read that it is suggested to embed any images for evidence into the actual appeal letter body?
    In terms of the actual letter revised as suggested. Would agree it's good to go to Popla appeal?

    Yes I'd say so.

    Embed images but upload a screen shot separately of the permission to appeal as lessee, and do the appeal in YOUR name with YOUR home address.

    I am concerned that POPLA will kick it back saying you are not the person/body who received the POPLA code and if so you will have to get Director to confirm that is their appeal.

  • Oh.
    I'm a bit confused now. I got the permission from director on the email. What more can I do?
    If that's the case why wouldn't I just appeal in the RK/companies name?
  • In the case of appealing in my name. Why would they kick it back then except another confirmation from the director?

    Why wouldn't it be more straight forward to continue appeal to POPLA as director/company RK. They'd be fine me doing it on their behalf, and it wouldn't require all the uncertainty with authorization etc?

    If the appeal is done in the name of the RK/director registered at companies house. Would the appeal need to be accompanied with a physical signature?
