Phone up and appeal, keep phoning- as above try for Dublin. If necessary send a letter before action to the buyer and then go to small claims. This is a case worth fighting for in small claims.

Op, as per post 91 and 92.

You need to phone and you need to get Dublin. You need to be clear in that you will pursue an action against the buyer and ask ebay to reverse the decision as you did more than the Ebay Money Back Guarantee requires.

They have refunded the buyer and I am being charged

OP best thing to do is contact Action Fraud

    https://www.actionfraud.police.uk

to make a report, just advise you sold something online, the buyer misused the returns system and has been refunding whilst retaining to goods.

Highly unlikely the police will do anything but they'll give you a reference number, you can then phone eBay back to appeal the case telling them the buyer hasn't returned the goods, you've reported it as fraud and here the reference number.

If they still refuse to reverse the decision send the buyer a message advising the goods belong to you and she has a duty of care towards them.

Then come back and we'll tell you the next steps towards filing a small claims case, but I doubt it will need to get that far.

    UPDATE:

Thank you all for your advice and help, I'd never have got through this debacle without you all.
I got through to appeals and they have reversed the decision and my Paypal balance has been restored.

I would take it from this that the buyer was still refunded by eBay as well as keeping the item? How do I go about blocking this buyer from bidding on anything again?

There should be a link in the "shortcuts" box of your seller hub.

    https://pages.ebay.co.uk/services/buyandsell/biddermanagement.html

finally a good result for you.

Well done for being persistent, it is frustrating and it is easy to just give up, but sometimes eBay CS reps just don't seem to get it and it needs a persistent seller to keep at it.

Just one thing, you should have blocked that buyer on first indication of them being difficult, I am quick to block as it means they can't be silly and start auction wrecking or anything. It still allows the case to go forward and allows the parties to contact each other, it just stops them buying anything more. Never allow a disgruntled or dodgy buyer access to any more of your items.

    Well done though

Nice result for you, eBay have likely taken the hit on this, it's a crazy position they are taking on returns at the moment.

Hopefully you can get a refund for the return labels the buyer didn't use so other than the time and stress at least you didn't lose out financially.

  • Just a general comment and not specific to the OP but I just got off the phone with CS in Dublin and I got through to them at first attempt.

For what it's worth I truly believe that 0800 to 1000 is the best time to talk to somebody who doesn't read from a script.

When you ring up ebay are there any security questions they ask you?

I'm having a bit of bother with a similar buyer who seems to be playing the game in order to keep both the item and receive a full refund.
  • I believe they can see your Id probably because the "PIN" number you give is relevant to the ID you made the call request with.
I do get asked for my name but it might vary from caller to caller or even which call centre you get.
