Hi,
Not sure this is the correct place...
Been separated from my wife for 9 months and find out she has sold the hot tub i bought.
Never was i asked and she refuses to share the money with me.
I have proof that i bought it but shes saying it was for the family, which is try but she can't just sell it???
Should it be an open and shut case in the small claims court under the sale of goods act section 12?

The small claim court is the wrong arena for these disputes. You need to see a divorce lawyer.0

Same principle applies. This is due to a marital dispute and needs to be sorted out either between yourselves informally or via a long term settlement. The small claim system will either reject the claim or if it gets to court the judge will bounce it out as not in their jurisdiction.0 -
