    Just to add - CEL are no longer pestering me about this one, usually they are quite keen to threaten court action, but they've kept quiet on that with me.

    The Harbour master is denying there are bye laws in force, they are saying the act which you quote says "bye laws may be put into effect or enacted but there are NO bye laws in place"

    Any thoughts?

  • lisk39, it would be extremely helpful if you could post images of the signage showing both the car park name and the amended time of 15minutes, as the PCN I got from Civil Enforcement said I didn't pay within 10 minutes. A technicality that would be enough to throw this out on appeal...

    Hi, I didn't get a picture of the change, but will take one next time we go there. It was only changed to 15 minutes around the time I saw it and posted I think, following a letter from Norman Lamb MP I believe.

    My PCN was cancelled by CEL recently. I cited inadequate signage for the new charges/cameras and Byelaws applying as I was not the driver. Hope that might help...

    I am in a similar position with CEL and Wells Quay car park.
    Having confirmed that the car park was subject to byelaws, how was the matter resolved?
    What documentation would you suggest I collate to make the same case for myself?
  • I recently parked in the car park and was careful to ensure I was under the 15 minutes free parking. Today I received a fine with 2 attached photographs: The first entering the car park, the second leaving. The time difference 15 mins 40 seconds! (You have to drive to park and then having reversed out of the slot I then waited at the end of the car park for an elderly person to park).
    So the fine is for entering the car parking area and leaving it, not parking as the sign says! I believe this is outrageous.
    Thoughts and not sure what to do next!

  • Thanks, will do. Just spoken to the Wells harbour office and they told me the 15 minutes includes driving in and out of the car park!
