    I have successfully logged online with MCOL. They have confirmed that my AOS was received on 26/02/2020. I will now email a SAR to CEL and I am writing to my MP too. Getting into this now. Any letters I have previously emailed to them was just ignored and I was sent a Cessation of Correspondence. Time for them to have to do something now. Just to confirm nosferatu1001, after having the AOS confirmed and that's all I do with MCOL, where do I email my defence to?

    Thats ok., Your comms have been reasonable and their refusal to engage is unreasonable, as they are supposed to continue communicating to avoid court whereever possible
    You could point that out to them, and state you will happily let any court know that they cant answer quesitons so pick up their ball and go home instead...

  • Thank you Coupon-mad. I have tried to down load the defence template for word and I get a gmail message appear "Error 404" ..and then.... "you are temporarily locked out". Had the same problem this morning. I will try to register with dropbox to download the online version. I have also tried to find the email address for Civil Enforcement Ltd and I cant find it on any of their letters or online. So now I can't even email a SAR to them. So I phoned and an automative voice wants me to just put in a PCN No. I can enter my query/question if I select the "contact us" online but thats it. I won't have a paper trail or no evidence of delivery. How can they not have an Email Address? Should I post it?

    Coupon-Mad, I have tried many different ways to try and paste and copy from the new defence template but my computer is either being too sercurity concious or its simply me not knowing how. So, I am typing it all into a word document manually. By doing so, I have found to my delight, that I am having to read and familiarise with every aspect of each sentence and I am taking it all in. It is a fantastic template to follow. Thank you.
  • Hello, I'm currently fighting a claim from this car park to, I purchased a full day ticket but was fined as i didn't purchase within 10 minutes as i was waiting for a parking space. I appealed with them and with POPLA and both were rejected. My defence has always been on entering the car park there was a 4x4 parked in front of the sign so i was unaware of the T&C's as shown on their photo of me entering. I have now had a county court issued against me which i'm currently filling in my defence. The question i have which may be of help to everyone else is - on my orginal PCN it states the incident was on 09/09/2018 and the PCN was issued on 29/11/2018 which is roughly 12 weeks apart. i have found this statement on resolver.co.uk -

    Is there a time limit on when private parking firms can give me a ticket?

    The short answer is yes!

    You should expect a private parking firm to fix a notice to your car before you leave the car park and then post you a follow-up within about 2 months.

    If the parking firm has to get your details from the DVLA to send you a ticket by post alone, they have to send it within 14 days.

    Outside of the Protection of Freedoms Act, the parking firm should give you sufficient opportunity to appeal. If the parking firm sends you a ticket four months after the incident, for example, you’d most likely be able to argue that this is unfair.

     So does this have any weight in my defence and if so does anyone know where i can find an actual law stating this to proof to reference?
