Hi All

On 28th of October last year I parked in the Port of Wells Car park. I put in my Reg and paid for the ticket which I still have. On the 5 Nov I received a PCN from Civil Enforcement Ltd stating I had not put in the correct Registration which I am sure I did. The ticket has only the last SDY digits of my number plate. At the time I thought (as some car parks do) that only the last three digits were printed. I appeal and Poplar have come back with unsuccessful. This is extremely upsetting and I am being chased for a further bill of £140 and threatening letters of courts and balliffs attending our property and taking our vehicle. I am a recent cancer survivor and have gone through so much treatment and this has left me so scared and upset.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

    Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem become so widespread that MPs agreed to enact a Bill to regulate these scammers. Hopefully, this will become law by Easter .
    You never know how far you can go until you go too far.

  • Yes, Port of Wells Car Park. Wells Next the Sea. The car park is owned by Wells Harbour and I rang them the lady said I can send an email but it most probably won't be reviewed at all.

    if yje car park is owned by Wells Harbour there is a good chance this is covered by bylaws and not relivent land , have you asked them if the car park comes under bylaws yet?

    Funnily enough I'm dealing with one of these today for that location. The PPC infested the site last summer - http://www.wellsharbour.co.uk/na918.htm
    The link states Creative Parking Solutions, but CEL is under that banner.

    There are bylaws in place, and I've contacted the Harbour Master to obtain a map of the area covered under those bylaws

    If confirmed that the quay car park is covered, then it is "not relevant land" as far as POFA 2012 goes, and therefore can only be pursued by the Harbour Master through the magistrates court - it is outside of the jurisdiction for a private parking company.

    Unfortunately Wells Harbour Commissioners do not get involved in individual complaints and there is nothing we can do.
