    The Ticket was Issued by Civil Enforcement. Payment by cheque on the back of the PCN is to be made to Civil Enforcement, Horton House, Liverpool. This new email is from Parking Eye with my Civil Enforcement letter attached asking for their legal process.

    This is why I too am confused.

    You must have emailed it to Parking Eye by mistake.

    Check your sent items, where (exact email) did you email that attachment?

    So where are you now?

    If they were to tale this to court, if this land is covered by bye-laws, and they do not know who was driving, they may cite Elliot v Loake, in which case they will crash and burn and you can threaten "unreasonable behaviour" revenge costs.

    What do you plan to do next?

    @OP - I note in your letter to CEL that you are 'experienced in litigation', so I'm not sure why they are making you 'scared and upset'.

    Wait to see how they proceed, then defeat them in court, if it gets that far. You should have no trouble.

    I think the PE issue was a red herring, no idea how they are involved but as CM said, I suspect you emailed them by mistake, yhis is clearly CEL

    nothing to do but wait for an MCOL from the CCBC in Northampton and then defend it , providing you have issued a SAR and obtained all your data

    this will all be settled when a judge decides, OR they discontinue at some point (within 6 years)

    The ticket has only the last SDY digits of my number plate. At the time I thought (as some car parks do) that only the last three digits were printed. I appeal and Poplar have come back with unsuccessful.
    You would have won at POPLA v CEL had you come here earlier. You ruined it by blabbing about who the driver was - a common rookie error.

    Come back when CEL try a small claim, if you are not at that stage yet (or are you?).

    How about just telling the truth. I would have to blab under oath anyway. I have been back to take photos of the signage and their are cameras everywhere.

    6 yrs of this. Yes I am scared and upset. After 2yrs of chemotherapy and 4 ops it has left me with almost zero confidence. But I did fight and I won for now.

    I am going to fight this too. I wouldn't want anyone at their lowest ebb parking in any hospital car park and getting one of these fines from such leeches.

    So the last letter I got from CEL was the Cessation of correspondence.

    I am hoping this means they don't want to take this any further. If they do of course I shall request SAR immediately for which they must produce within one month and free of charge. Such unpaid work should reduce their resolve even further.

    Redx, I think your right, and I sent the email to PE by mistake.

    So I am not at small claims yet but I will get back to you if this indeed becomes the case.

    yes , very common

    I assume you have seen police programmes and dramas on tv where the alleged perpetrator is read their legal rights (like MIRANDA in the USA) and they say something like

    "before you say anything , listen to me"

    "you have the right to remain silent , if you give up that right anything you say may be used against you ina court of law, blah blah"

    and the crims always say "no comment" on the advice of their lawyers, or previous experience if they are serial offenders

    it never ceases to amaze the regulars here how often people fail to do so and in "telling the truth" have dropped themselves in it

    the UK system of law is INNOCENT , until proven GUILTY

    hence wht these companies have to prove they have a valid claim, whereas the defendant can just say "prove it" followed by "no comment" , lol

    hope that helps
