Funnily enough I'm dealing with one of these today for that location. The PPC infested the site last summer -
The link states Creative Parking Solutions, but CEL is under that banner.
There are bylaws in place, and I've contacted the Harbour Master to obtain a map of the area covered under those bylaws
If confirmed that the quay car park is covered, then it is "not relevant land" as far as POFA 2012 goes, and therefore can only be pursued by the Harbour Master through the magistrates court - it is outside of the jurisdiction for a private parking company.
Hi StaffsSW, did you manage to find out if the quay/harbour car park is indeed covered by Bye Law? (I have a court claim from CEL for this car park, and am currently trying to do my defence)
Thanks (ps.links removed due to new user!)0 -

Please delete your post; this is called hijacking and is unfair on the OP of this thread.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hello woukd any of the previous users who had (or could take ) photos of the signs at this Port of Wells Harbour car park be able to post them please?0

You need to contact these people by pm.You never know how far you can go until you go too far.0

lisk39, it would be extremely helpful if you could post images of the signage showing both the car park name and the amended time of 15minutes, as the PCN I got from Civil Enforcement said I didn't pay within 10 minutes. A technicality that would be enough to throw this out on appeal...0

Staffs did you manage to get a copy as the harbour masters are not forthcoming1

Would an FOI be possible?
Also, a complaint in the local paper about this scam might focus minds. You never know how far you can go until you go too far.0 -

I did get an approximate, low resolution map which I'm trying to find again, but it came from the local council not the harbour master. The car park was clearly within the boundaries of the Wells Harbour estate. The pavement and road was shown as being local authority land along The Quay and Beach Road, with all land, and marshes being part of the harbour estate.
I did also find this reference though, page 5 of their annual brochure - http://www.wellsharbour.co.uk/docs/whc/2019_port_brochure.pdf
"But perhaps what visitors don’t realise is how big the harbour estate is and what a vast area the Commissioners are responsible for. Many Acts over several hundred years and the harbour Revision Order of 1994 clearly state the harbour stretches West to the middle of Holkham Gap, one mile seaward and East as far as Stiffkey pipeline and more importantly all areas within these boundaries that cover on a spring tide. "
Just to add - CEL are no longer pestering me about this one, usually they are quite keen to threaten court action, but they've kept quiet on that with me.<--- Nothing to see here - move along --->1 -

Perhaps they have read this and realise that they are on a hiding to nothing. You never know how far you can go until you go too far.0
