    If confirmed that the quay car park is covered, then it is "not relevant land" as far as POFA 2012 goes, and therefore can only be pursued by the Harbour Master through the magistrates court - it is outside of the jurisdiction for a private parking company.

    Hi StaffsSW, did you manage to find out if the quay/harbour car park is indeed covered by Bye Law? (I have a court claim from CEL for this car park, and am currently trying to do my defence)

  • lisk39, it would be extremely helpful if you could post images of the signage showing both the car park name and the amended time of 15minutes, as the PCN I got from Civil Enforcement said I didn't pay within 10 minutes. A technicality that would be enough to throw this out on appeal...

    I did get an approximate, low resolution map which I'm trying to find again, but it came from the local council not the harbour master. The car park was clearly within the boundaries of the Wells Harbour estate. The pavement and road was shown as being local authority land along The Quay and Beach Road, with all land, and marshes being part of the harbour estate.

    I did also find this reference though, page 5 of their annual brochure - http://www.wellsharbour.co.uk/docs/whc/2019_port_brochure.pdf

    Just to add - CEL are no longer pestering me about this one, usually they are quite keen to threaten court action, but they've kept quiet on that with me.
