    You have a whole bunch of people helping you. We are now asking you to help us by going through the ITAL process on our behalf so we can help others who will follow in your footsteps.

    Do it very carefully, step by step, checking back here before you do each stage. Without a valid ITAL appeal code nobody here has any idea what the happens during the process.
    As far as we know, ITAL have never done parking appeals before so we don't even know if the assessors have been trained.

    Tell us as much about the process as you can. What questions do they ask, what are the timescales, as C-M says, is the decision binding on the motorist, etcetera?

    I note that ITAL are members of the BPA and are heavily involved in collecting penalty fares for the rail companies. Is there not a conflict of interests here? Does this not compromise their impartiality?

  • Ok so I’ll go through the ITAL process and I’ll send it all in writing each individual time to them

    I still have no idea what to do regarding the 3 tickets I appealed on Ipaymypcn and those 3 now that have come through on a seperate appeal to Indigo both have different time frames obviously so which do I base it off?

    I will be writing my letter up on the 15/16th of this month to post when I’m back from Holiday

    In it I will include
    -Lack of a text box to sent a proper appeal to Indigo
    -Their app failing after working fine for 6 months
    fault is with them
    -My company pays all my travel costs so it would be of no benefit to me atall to try and scam then (can provide concur statements)
    -Indigo sending me to a 3rd party claims site so a 3rd party handling a 3rd party on behalf of the railway system
    -I offered to pay the full ticket fee for those dates
    -The law says the fine must be appropriate to the unpaid fees, £600 for £50 of parking tickets is not even close
    -Ipaymypcn have sent me 3 emails without offering a reduced rate of £60 which they have to by law.

    Anything I should include or omitt from this such as do I ask in my ITAL appeal whomis liable the driver, registered company or the lease holder?

    Not relevant land is the biggie. Under POFA transfer of liability to the keeper can only occur under certain circumstances. Railway land, being subject to byelaws, means they can't use POFA.

    You are the registered keeper. Do not hint at being the driver or owner and they can't make you liable.

    Byelaws state the owner is liable.

    State explicitly they have not demonstrated you are the owner or driver.
  • I noticed that which is why I said is there even a point and will it end up just costing me an extra £240 as they clearly advertise as being able to prosecute quickly and successfully?

    Apparently from a phone call they are new to handle parking appeals “independant and unbiased from Indigo” but with regards to which ITAL code to go from and who Ipaymypcn are and they Indigo logo on their websit is just to show they handle their appeals. As Yorkshire man I have a keen nose for bs
  • I am the registered keeper but not the owner and I’m quite sure in my appral to Indigo in a panic I acknowledged I was the driver of the vehicle at that time, does this matter?

    Try appealing and see what they say. We are in crystal ball territory. We do know Indigos contract doesn't give them authority to go to court and under GDPR they can't go spreading your details around so don't panic

    Trying to scam a motorist who is aware of the wording of POFA where it concerns bye law land is a futile exercise for PPCs. They have no hope of getting a penny out of the motorist and every letter you write costs them more money, so do not hesitate to engage with them.

    Have you complained to your M.P? If not, you should.

    Nothing matters because the whole scam times out in 6 months, and Indigo have NO remit to sue in their contract with the train operators at railway sites, as you will know from other Indigo threads we hope you've researched.

    yup , have they been granted permission to bring a prosecution in the TOCs name?

    cleverly set up , indigo cannot give info to non bpa member ,

    HOWEVER

    should the "accused" choose to write to ital , then that bypasses KODOE rules

    this needs watching carefully , as in the case of IPC/gladrags , doing an appeal is simply handing them the (incriminating) ammo it needs
