So im not sure how to attach images will try later but basically
Had 3 rejection emails today from Ipaymypcn. Ive had none from Indigo. Basically I followed the instructions on the PCN which directed me to their website and I appealed 3 out of 5. I then proceeded to appeal all 5 on Indigo
Ive spoke to them on the phone without giving details they said I have to appeal these 3 at ITAL group ltd, there’s a note about Ombudsman services I can appeal at but the BPA isnt involved with that. She also said they can send debt collectors without a court case or tribunal case, word for word they said that.
Do I have to pay any attention atall to these people who are a third party working on behalf of a third party (Indigo) on behalf on network railway?
Whats my next step? I never appealed the other two with them just with Indigo, do I have to check online to see Indigos appeal results or do they have to contact me?0 -
Oh and they’ve said they don’t have to issue POPLA codes for private land PCNs anymore0

So it says at the bottom by law they are required to inform you about an appeal through Obudman services (popla) but the BPA doesnt want to be involved with that, then the next page says you can appeal with ITAL group ltd within 28 days
They have also not offered me the PCN at the original reduced rate
Anyone with a quick bit of info, should I wait the 25 days and write to obudman services or asparking.co.uk (ITAL group)0 -
The process is, you appeal to the PPC (Indigo)
The appeal is either upheld, and that's the end of things, or they reject it and supply a PoPLA code.
If any of your appeals have been rejected with no PoPLA code supplied, you complain as already advised.
In addition, stop 'phoning the scammers or their agents. The NEWBIES is quite specific about this and in one of your earlier posts you said you would only contact the scammers in writing.

The code for ITAL also seems to work for POPLA. I would do an appeal to both using the same code. Do them at the same time and see if chaos ensues as both organisations try and figure out what is going on.
Your main appeal point should be no keeper liability as not relevant land.
Don't stress over this Indigo are absolutely powerless to do anything despite their downright lies about sending baliffs around. Ask them to put that in writing and see how far you get.0 -

second to appeal before I simply asked if any new ones had been generated.
I know I have 28 days to appeal to Popla and Ital when should I ideally do this, last day possible and by post?0 -
Do it online. Don't leave it till the very last minute but towards the end of the 28 days.0

It is the will of Parliament that these scammers be put out of business.
Hopefully that will take place in the near future. The Bill has passed through the HOC without hitch, and goes to the Lords soon. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers.
This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.
Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.
Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.
All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.You never know how far you can go until you go too far.0 -

Since these are byelaw case, you want to string them out to 6 months, so appeal ever PCN as late as possible but without missing the appeal deadlines.
If you get PoPLA codes, do the same. Appeal as late as possible.
If they refuse PoPLA codes, complain to the BPA, DVLA, and your MP about each one. The DfT told PoPLA they should be allowing independent appeals to be made back in June 2018. There was nothing from the DfT that they cannot be backdated to when PoPLA decided not to issue codes for byelaws. Only the scammers and their agents (BPA, PoPLA) have said this, not the DfT.
It's a matter of interpretation and intent. The DfT wants independant appeals, they said they wanted them re-instated, they did NOT say they couldn't be retrospective. Well luckily I did the mistake made by them at their end means these tickets are almost 2 months past now to this date (4 from a weekly parking start of November and 1 from the first of December)
Like before I applied to Ipaymypcn which was on the back of the lettered PCN and they generated 3 ITAL codes. Now today I’ve heard from Indigo (I appealed at the very end of december) and appealed all 5 but for the 3 I had already appealed they have generated brand new ITAL codes?
1. Do I reply in writing to Popla to appeal or is appealing online alright?
2. Do I apeal with the new ITAL codes or appeal all 8?
3. Is there a specific template how I write my appeal to Popla out?0
