It still doesn't matter. Indigo cannot prosecute. Only the train company can do that. Indigo can't pass your details over due to data protection laws.
The train company can't access the DVLA details. Don't stress.0 -
actually on this one they have 35 days to issue POPLa codes , and those run for about a month , I would pester and pester them untill they drop this or give codes , garlic munchers do not like giving 5 x codes at "£25 each , when they know they will loose
however I expect you will just get begging letters from DPR etc , be on the ball and ask them for the POPLa codes as they had 31 days on them0 -
It may be more than 6 in all fairness could potentially be about 10 🙄
So from what I gather my next step when they deny my appeals will be to write to them requesting POPLA codes even though they will be denied but to drag it out.
They never contacted me via email even though my email is linked to their bloody app just 4 threatening PCN’s and 1 not arrived but that’s the first of december may be another 6 more for this month coming0 -
They should be offering POPLA codes now.

If they don't, complain to the BPA.

I think they're in a bit of a mess with this! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

For future ones stop blabbing about who the driver is. Although Indigo are impotent in these case people always feel more at ease when they have certainty. A win at POPLA gives that sense of certainty.0 -
the chance of you getting 6 x POPLa codes (as required by UK legislation ) are to put it ,, very slim
they will use every excuse in the book , lost in post , spam folder etc etc watch the dates (max) that they are due , then ASK them , if ^^^^ hit answer complain to BPA
they are obliged by UK law to offer an independent appeal service , however as this land comes under bylaws (and other failings) they will ;loose if they contest0 -
As of the beginning of November, I believe all BPA members should be giving PoPLA codes even where Byelaws apply.
Complain to the BPA, DVLA, and your MP if you don't get them.
Separate complaints for each and every PCN.
The ADR Act 2015 states that alternative dispute resolution should be available for not less than one year in each case.
String each PCN out to six months by asking lots of inane questions every fortnight.
Who is liable? (Driver, keeper, owner?)
Which specific Byelaw?
Who can initiate court proceedings? (PPC scammers. ToC, Landowner?) (That's a good one)
In what court? (Small claims, County Court, Magistrates Court etcetera?)
After how long does a byelaws court claim become statute barred?I married my cousin. I had to...I don't have a sister. All my screwdrivers are cordless."You're Safety Is My Primary Concern Dear" - Laks0 -
Can I just say a thank you to all for the help
I will await their verdicts and any further letters, I put my new address on but hopefully they are to stupid and send it my old address
I will respond everytime in writing to them from now on and only in writing and keep every proof of receipt sent to them
I will update throughout as more information comes to assist anyone else in future cases
Thank you all and hope you have a Merry Christmas!0 -
Oh, once they reply what is the maximum time I have to respond within is it 28 days or 20 days?0

the next mail you will get will be from zzps debt collectors saying you are to late to appeal , as no appeals were received
indigo will huff and puff but not give you popla codes , the BPA will back them up saying you should have used registered mail , when indigo state they posted popla codes by 2nd class post and they got lost , bpa will say 2nd class is acceptable0
