    I’m still on the payment plan well into next year, I believe they will still try to take payment for another 150 plus. I didn’t sign any agreement. Letters threatened with potential court proceedings etc. I was worried about my credit rating at the time.

    So as I have already said there is a possibility that 'agreement' was/is recorded somewhere and you cant assume they don't have it as we all know assumption is the Mother of all F***ups.


    So you have already paid 150, how much in total are the scum demanding and what for ie how many PCN,s etc


    If they want another 2k then hell yeah cancel the DD but if maybe 250-300 in total then take it on the chin, get educated more about parking scammers and their dirty tactics, learn the lesson, job done!

    We all know, those that have followed the private parking industry, that it is accepted that contracts can be made simply by actions.

    As onlyfoolsandparking has said, by actually paying DRP some money according to a plan, you have agreed to terms of an agreement.

    I believe your only hope is to look further into the suggestion made earlier by Castle - about misleading and aggressive commercial practices.

    I think its a tough one to call, even without the written agreement of entering into a payment plan the proof is there with actual payments and a possibility of DRP scum having a recorded conversation (although I doubt the dummies could find it to produce as evidence if it went to court).


    I think there's similarities to be drawn with the statute barred debt rules, if the debtor pays a single penny (probably more that a penny in reality) the 6 year clock is reset or that's my belief so now OP has entered into payment plan a contract may have been formed with D.irty R.at P.eople

    NO ... in the same bill it says

    Aggressive commercial practices
    The 2008 Regulations make aggressive practices unlawful (see regulation 7). Whether a trader has behaved aggressively is a question of fact, and depends on whether it
    significantly impairs or is likely to significantly impair the average consumer’s freedom of choice. It covers the use of harassment, coercion or undue influence.


    This is what is called DRP, ZZPS and DCBL and the other joker debt collectors who pop in and out.

    The OP no doubt had his freedom of choice impaired with threats

    This conversation took place some time ago, but essentially I was told that court action would be taken against me, I argued that I couldn’t afford the amount requested, I was offered the payment plan as a final and only offer over a period of 12 months.
