Hi, I’ve read the newbies thread as regards DRP letters. Unfortunately and rather stupidly I was unaware that these letters could be ignored until much later on. I am currently on a payment plan. I’ve not been able to see from the Newbies FAQ, if anyone has before cancelled their direct debits and made no further payments (when already having made payments to DRP).
I essentially want to know if having already entered into a payment plan alters things legally? What could DRP do if I were just to cancel any further payments? They’ve already had 150 plus from me, and I’m so mad, having now read more info in the forum.
Any advice would be greatly appreciated.

That's a damn shame, not stupid on your part you just fell for the scam as unfortunately many do.

If you have agreed a payment plan with DRP then you would be unwise to cancel the Direct Debit.
You have agreed to pay a certain amount each month and without having seen the full terms that you have agreed to, I fear that is what you must do.
What could DRP do?
They could sue you for the outstanding balance on your agreement.0 -

Did you sign any agreement with them ?
Did you do this because of threats such as CCJ's, bailiffs, bad credit rating etc etc ..... tell us how much they tried to scare you0 -

Misleading actions
The 2008 Regulations make misleading actions unlawful (see regulation 5). An action by a trader is misleading if it contains false information or if it is likely to mislead the average
consumer in its overall presentation.
And with DRP, they provide false information0 -

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.
Parking Eye, CPM, Smart, and another company have already been named and shamed in the house as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week, hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an
M.P. for unprofessional conduct
The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the House of Commons recently

Whilst DRP did not own the original debt, they do have an agreement, i.e. a contract, with Jay8705 to pay them £xx per month.

On that, we await to see if Jay8705 actually had a written agreement with DRP .... or as we know, it was done over the telephone
DRP constantly make misleading statements which the law states
"make misleading actions unlawful"0 -
I think its a tough one to call, even without the written agreement of entering into a payment plan the proof is there with actual payments and a possibility of DRP scum having a recorded conversation (although I doubt the dummies could find it to produce as evidence if it went to court).
I think there's similarities to be drawn with the statute barred debt rules, if the debtor pays a single penny (probably more that a penny in reality) the 6 year clock is reset or that's my belief so now OP has entered into payment plan a contract may have been formed with D.irty R.at P.eople0
