    Why have you received 2 more claims? What is going wrong here? Are you ignoring the originals from the parking company? Are you up yo date at the DVLA? If not do so urgently, there could be more surprises in the pipeline.

  • I have called the courts and the case is stayed at currennt, the courts are waiting for BW legal to say they wish to continue

    I have received 2 more claims relating to the numoruos other tickets i received over the course of as many months, each time just hoping it would go away.

    Can i ask please regarding my first claim, the defence was filed and the case is currently stayed, I read the previous letter from the courts this morning saying if the case is stayed the claiment will then need to apply to the judge to allow it to go further,? why would they let it go to "stayed? and can they apply to carry on at any point they wish in the future, ? is there a time limit cases can remain "stayed"?

    I suggest asking the court: -
    a) why the case was stayed?
    b) for how long?
    c) how/when does the case become dismissed?

    I tried to find info by asking Auntie Google and came up with one year but that was in a non-civil case. Anywhere else wanted to charge me money to buy law books!!

    thanks for your reply. I have phoned the court and the case is stated due to them not receiving bw legals DQ, the court say they will have to pay to get in un stayed and they can do this anytime in the future. it can remain stated almost indefinitely. the court suggested incontact them and ask them why they haven't submitted there DQ. I am reluctant to contact them and would rather it go to court with a moral hearing and let the judge decide on the day. any advise on my best route from here. as the clash sang. should I keep it "stayed" or should I "go" to them saying I wish to proceed to court

    I agree, I wouldn't contact them, it might remind them to get after you! IANAL and cannot advise on the staying (not stating) but hopefully someone with legal knowledge can answer the point about how long cases can be stayed.
