Received a CCJ claim from BW legal for a parking ticket

HI,

I have now completed the AOS online and will now put a defense together.

I am sure i will be back in the next days or weeks for more advise or to read other peoples outcomes.

Don't sit waiting for something to arrive from the court - it doesn't yet - your AOS is in, so the ball is still in your court, for submitting a defence in time.

You need to show us your draft defence during October, so we can assist you to make it a good one! We need something to work with though, so go and find some good ones as linked in the NEWBIES thread post #2, there are several defence examples there written by me, bargepole, Johnersh and others.

hi. I am sorry but 8 ua e not read you last post and already submitted a defence. I now feel this was a leaky and poorly put together. 8 received another letter from BW legal saying they know it is copied and pasted and want to continue the case. can I still win this as I do not want to give up for these crooks

Apologies for the reply,


My first defence has been submitted and confirmed as received by northampton courts,
I am yet to receive a directions questionnaire, this has now been 2 months,


I have also recently received 2 more claims from the courts and want to fight these claims in a more convincing manor as i rushed the first one and feel thwat may lose if it goes to court,
I even had a letter back from BW Legal saying they know i copy and pasted it.

Have you checked with MCOL that a DQ hasnt been sent out? 2 monhts is aLONG time to not have a DQ. You may already have judgement against you if they sent a DQ you havent responded to.

Of course they said that

We dont even know what defence you sent
What work youve done in the meantime
What stage you are with these two new claims - issue dates? Have you acknowledged service? etc. All the post 2 of newbies thread stuff, basically.

If this is the same car park, same circumstances or similar enough, then you NEED to ask these cases to be heard together - BW Legal KNOW they shouldnt be issuing seperate claims, their duty is to the court NOT to burden them, and they should all be in one hearing
You do this in the defnece - listing all the claim numbers, on both new defences - and later in the DQ stage for all THREE

But get checking on that DQ.

Once all 3 defences are IN, and not before, keep putting a clear covering letter at each stage from now on, which cites all 3 claim numbers and asks for the 3 claims to be put in front of a Judge to order that they be combined into one hearing, because this is an abuse of process and an onerous burden on the Defendant and the courts alike.

State that should the court agree and combine the cases, your defence in claim no. xxxxxxx (i.e. one of the better ones!) will suffice as a 'test case' defence to represent all three cases and save duplication and the court's time, and you hope the court will only order one Witness Statement and one set of evidence to be filed & served, to avoid stress, costs and time, given that all three cases should have been filed as one single claim as the facts are duplicated.

At some point down the line your local court will pick that up and run with it, I hope.

I have just checked the MCOL site and there is no mention of the DQ being sent yet,


I am now on hold with the court for verbal confirmation.

Just to be clear, the covering letter is what i send with my defence in the email to the courts??
