    Good grief! I can't believe how out of hand this thread has become! :eek::eek:

    I realise that as a smoker I'm outnumbered, but for goodness sake people, take a good hard look at yourselves!!

    OP has every right to smoke in her garden, wherever in the garden that may be, no laws are being broken, equally, the neighbour has every right to shut the window for a few minutes!! The amount of smoke that drifts in will not "fill the room"!! OP's neighbour could well be doing as much, if not more, harm to her child buy the use of whatever chemicals are pumped into the air by air fresheners, household cleaners, scented candles etc.!

    Yes, we all have social responsibilities towards each other, these include NOT vilifying someone for living their life in the way they chose, while breaking no laws! I don;t like the smell of my neighbours petrol driven mower, or hedge trimmer - solution - shut the damned door/windows for a few minutes - problem solved! I certainly don't expect my neighbour to stop mowing his lawn or trimming his hedge because I don't like the fumes!!

    Get a grip people! or better still - get a life!!

    We all know people have a right to smoke - op asked for opinions on how people would handle the situation - you sound very upset about them

    Yes OP has the right to do whatever she likes, its her garden. But i dont see it as such a hard task to move slightly out of the way to stop smoke going into their child's bedroom.

    Do you expect the neighbor to be on hand 24/7 to keep an eye out of them going for a smoke, by the time they smell it, it will be too late and already in the room. Second hand smoke is dangerous.

    Half expecting comments that the neighbor should leave the window closed 24/7 now.

    Certainly not my intention. All I'm saying is that IMHO, there is a massive over reaction to what must be a tiny amount of smoke drifting in through an open window! Yes, OP could move further down the garden, but the wind speed and direction could change and it'll make no difference whatsoever, OP could smoke indoors, but then the same people suggesting that now would be up in arms about the smell of smoke in the house should it ever be on the market, and complaining that the owners should have at least smoked in the garden if they wished to do so!!

    Is there views that there is no such thing as society? Ive not come across that before. Of course i believe society exists. There are many examples of it across the world.

    Interestingly the fact that we have many variants across the world suggest that social responsibility is something that is rather subjective. Which is my point.

    It's not.
    It's your responsibility not to kill them .... and to not behave in a way that is a nuisance to others. In fact... it's possible nuisance is in your deeds...

    I find <insert generic stereotype here> people a nuisance, you reckon i can take them to court.


    For inspiration between < >. THink along the lines of.... asian, fat, old, slow, smelly, colourful, tall, short or any other aspect of life.

    I mean i do honestly really hate cats. I cant see anything but them being a pest. There one that comes in to my garden craps on my vegetables and then proceeds to dig everything up. Ive got a two year old daughter and the dangers of cat faeces are well known. Theres a real risk of danger to my families health. What can i do about that?

    Im not allowed to shoot it, im not allowed to harm it, i cant physically stop it entering my property nor are the owners in anyway accountable for the actions of the cat. So what do i do? I mean i could go round and give abuse to the cat owner but lets be honest, thats not stopping it. So what do i do? I put spikes in and around my veg bed to make it awkward for the cat to find a comfortable position, i put half filled water bottles in an attempt to scare it, i use windmills so theres always movement around, ive got reflective spots to attempt to discourage, i go out every morning and remove any poo. Why, just because someone feels its their right to have a cat? Damn right it is and who am i to deny them that.

    Personal opinion is i wouldn't want my son to inhale second hand smoke through his window when it was open, if i was to ask a neighbor to move to the other side of the garden i would imagine they would just do it as its a perfectly reasonable request to make, and an easy fix to implement.

    How awkward you and your neighbor want to be is upto you both.

    I'm with Grezz24.

    I'd add option 3 though - Give up smoking and enjoy the financial and health rewards that brings

    "Nuisance" normally doesn't kill you. Passive smoke does.
