  • Sorry i disagree and feel the OP should be free to smoke anywhere on their own property...im an ex smoker (the worst kind) and i cant stand the smell now days.

    However i fully appreciate it would be wrong if i asked both my neighbours (each side) to stop smoking just because i hate the smell,its there garden and they should be free to do what they like.

    My wife cooks dry fish outside and believe me unless you have smelt it you cannot appreciate the stench...its like 3 week old tramp socks being cooked,good god its vile hence why she cooks out side...do the neighbours object,yes probably but they keep there opinion to themselves and id hope for the same reasons i do regards there smoking.

    Believe it or not I have been going through the same smoking dilemma from new neighbours downstairs basement flat (We are in the rest of the house above) for the past three weeks.

    Two new chaps are absolute chain smokers and sit outside in their patch of garden all day every day (one doesn't seem to work) and the smoke rises up to the two bedrooms at the back of the house. In addition they have friends over nearly every evening and all sit outside smoking. Its obvious they dont smoke indoors, as at 2am you will get a waft of smoke as one or other has stepped out for a puff.

    I am also an ex smoker so extremely sensitive, but what I deeply resent is walking into my bedroom and it it smelling of smoke even though the window was closed all day, it managed to seep in. The lodger in the room above mine has also complained of the smell in his room.

    I am not sure how to deal with it as they are incredibly hostile not even a courteous nod of greeting. I am sure if I asked them to move further away it wont make a difference (wind direction and speed, plus personal property and loads of other unknown rights) and i will get a mouthful of abuse and my poor OH is too ill for verbal hostilities.

    if its a flat do you rent? report it to letting agency / management company

    the letting agent will probably say the tenancy agreement bans smoking inside the flat so tenants smoke outside not through choice but to avoid eviction for breach of their tenancy

    We own the House three floors above - the Basement (former kitchens and coal storage in another century) was sold off and converted into a 1 bed flat with a patch of outside space. I spoke to the Landlord's son about it, he shrugged and said at least they are not smoking in the flat and there isn't much he can do about it. :( Just hope they dont stay there longer than the usual 6 months.
