I’m stunned by many of these replies. My neighbours smokes in his garden and occasionally I can smell it in my house. I’d never dream of mentioning it because he’s not doing anything wrong! How controlling do you have to be to think you can dictate where your neighbours can and can’t smoke on their own property?!0

It's not controlling, it's common courtesy, non smokers are a lot more sensitive to smoke odours than smokers are and it's not pleasant. You might not mind being poisoned in your own home but many others do, or don't you actually know of the risks from passive smoke?0 -
So why don't you tell them to smoke in their own house then and stink out their house instead of yours.

How would the non-smokers know that their neighbours are about to go into the garden to smoke and that they need to close their windows?
Or perhaps the neighbours should never open a window just in case the smoker wants to have a fag.
All it takes to be neighbourly is to stand in a different part of the garden while smoking.0 -
Also don't forget to all the ones who are saying to the OP move to the other end etc. Make sure you make no noise in your house - TV on/listen to music - use headphones.
No hanging pictures up - that way no drilling/hammering annoying the neighbour.
Also no babies/toddlers or dogs - due to the noise.

Ever given any thought to quitting smoking ?
You do know its likely to kill you, coffin nails seem to of increased in there strength in recent years, both my in laws dead before they were 60 from lung cancer, both 10 a day smokers for 40 years, 36 years ago my dad went the same way, i have seen friends and work colleagues suffer the ravages of this awful habit too, again, only one winner in this game.
One common factor among all of them, they all banged on about their rights, there's..............no thought to the people they would leave behind.

Don't forget the cats - Sneaky little burgers going around crapping in all the gardens in the neighbourhood. Then there are the midnight fights, always right under a bedroom window....Her courage will change the world.

I've a friend in a parlous state at this very moment. I remember arguing the toss about the new smoking ban in pubs with her and another friend when it was due to be introduced. But they never agreed to my suggestion for an occasional visit to an alternative non-smoking venue, as I'd leave that one after a short visit with streaming eyes, a cough and the need to strip off and wash my hair when I got home.
I'm a veteran team sports player, and having an annual medical a few years ago the sports doctor observed that he could see I'd never smoked. Which is why it upsets me to see one of our juniors smoking at training. Of course she has a right to, but it's going to have an impact on her life, not just her ability to play sport. I just wonder how she can afford them!0 -

Of course it's anyone's right to do whatever they want. It's considerate to take notice of others though.
I'd say smoking is one of those things (as demonstrated in this thread) that many people feel strongly about. So you may want to consider altering your habit slightly for the sake of those around you.
Or not, but just remember if your neighbour starts listening to house music at 2am/having lots of late night garden parties/dumping litter on the pavement outside your house, you don't have a leg to stand on.0 -

Besides you can still get an ASBO for repeated noise nuisance irrespective of whatever offences your neighbours have allegedly committed.0
