Just phoned the Court as the DQ is still not showing as received on MCOL.

They are processing DQ's from 11th at the moment, next week they should be on the 12th.

I shudder to think how many they are receiving, they were processing the 9th on 17th April.

I was worried that it had to be filed with the court by 29th (coming Monday).
The lady on the phone said everything is dated stamped when received and as long as I have the email reply saying it's been received by the court before the deadline all is fine.

Easy for her to say, still doesn't stop me from worrying though

Just phoned court again, they are now processing 23rd April.

No sign of the DQ that was emailed on 12th.

She told me to email it again as a duplicate document with the email auto reply I received from sending the first one, a manager would look into it.

Strangely I am getting no auto reply now after sending it in, although their email server could be very busy.

She couldn't get her head around how I had emailed it on the 12th when they only sent it out on the 11th.

It took me a while to explain that I had downloaded a copy.

If it still doesn't show on MCOL next Friday I should ring back.

We received a reply from the ICO this afternoon.
Thank you for submitting a complaint about the processing of your personal information.

    The ICO’s role

Part of our role is to consider complaints from individuals who believe there has been an infringement of the Data Protection law.

We use complaints to build up a picture of an organisation’s information rights practices so that we can identify and target poor performing organisations. Details of the action we have taken is available on our website.

    Your complaint

We have considered the issues that you have raised with us and have written to the Chief Executive, via the Data Protection Officer, to explain that we expect their organisation to work with you to resolve any outstanding matters.
One of the ICO’s strategic goals is to increase the public’s trust and confidence in how personal data is used and made available.

In this case, we expect the organisation to fully explain to you how they have complied with their obligations under the law as comprehensively as possible, including correcting any issues that they have identified or clarifying any areas of misunderstanding.

I have attached a copy of the letter that we have issued to the Data Controller and expect they will be in contact with you in due course.

    Yours sincerely,

    Sxxxx Cxxxxxx
    Case Officer
    Information Commissioner’s Office

Also an email from the County Court the other day
Thank you for your recent contact with the Court regarding the return of your Directions Questionnaire. I would like to offer my apologies for not processing this in the normal timeframe, but would like to reassure you that it has now been processed, and inform you that your case has now been transferred to [local court] as requested. Once again, please accept my apologies for any inconvenience and distress this oversight may have caused you.

Rachel, HX's DPO sent a reply to the ICO complaint today

    From: DPO
    Sent: 21 May 2019 13:28
    To: XXXXXX
    Cc: casework@ico.org.uk
    Subject: ICO Correspondence [Ref. XXXXXX]

    Good Afternoon,

In regards to the attached complaint you raised with the ICO relating to your Right of Access request, we have been asked by them to contact you in regards to this.

As advised previously, the pay and display machine data will not be provided as vehicle registrations are deemed personal data under GDPR. Along with this, as you did not enter your full and exact vehicle registration, there is no records of this therefore we cannot provide data that does not exist.

Your personal data is only stored in the UK, as advised in your right of access request, on servers located in Maidenhead, with a back up database in London. Zatpark do not store personal data relating to Parking Charge Notices in Amsterdam. This data is unrelated to Parking Charge Notices therefore is not applicable to your personal data.

    Regards

    Rachel
I could argue that staff member EB knew exactly what was entered into the machine to identify the vehicle in question as he entered it as a note on the ZatPark software they use on 06-04-2018 10:07:44

(I think RD was in Slithering)

As for the locations enforcement data are stored ZatPark seems to say different

It seems another nudge from the ICO is on order?

    Yes indeed.

You could also argue that your 'personal data' entry relating to that machine is the £x.xx payment matched to the ref 'xx' given that HX are known to have faulty machines that only record partial VRNs, and that this is the ref that their machine allocated to it, so that's your personal data and you are not asking to see other people's car numberplates, or in fact any car numberplate entries.

Did you read this one and the links, TrustPilot reviews, etc:

I know you are on this case but this builds a real picture of deliberate or negligent, even possible fraudulent scammery...

If you need any extra evidence I can send 2 pics of tickets from one of their car parks where the machine wouldn't put a reg in on separate dates.

There is also a error in their witness statement they'll send out that I'll tell you but not in public viewing so they can't change it.

Quick question as I'm about to start writing a Witness Startement.
As I only have a mono laser printer is it acceptable to the court to print out any images in black & white, or should I go to Asda (or similar) and get colour prints?
