Hi Beamer. When HX/Gladstones sent me a copy of the witness statement there were 41 pages, the first 7 from the CEO of the company and the rest various correspondence between myself and HX.
One page was a copy of an email from me which they said they had never received, another was a letter which they also say they never received including the proof of posting which I'd sent them. Another was the letter they sent to my MP saying that they would reduce the charge back to £60 for 14 days and on the next page was a demand from them for £85 only 5 days later.

They also very kindly included a letter that I'd sent to HX about a case in Staines where the judge dismissed the case because it was proven that a ticket had been purchased, as in my case. All this in THEIR w/s to the court by the way. Sadly they still get paid even if they lose. Happy note, it's the ppc who have to pay them.

Amazing ...... Gladstones are seriously screwed up. They must be the laughing stock of real solicitors who would never dream of taking on these fake claims

The defence is pretty much Pjr1525's defence with bits changed/added
  • Sue Hayman MP for workington is putting together a group legal action against HX specifically for Vulcans lane car park.
This may or may not be relevant to people following this board. Google her. She has previously called for constituents to boycot it.
She can include constituents from other areas but cannot advise or assist people or with incidents outside of her constiuency- this is due to strict parliamentary protocol.
    Chin up.

Just re-reading the thread and when looking at the image in post #44, I noticed that HX have an "Appeals and Payments" department - so does that mean that the same work experience yoof initially handles appeals and payment details received? :D

And after initially offering Mrs Hayman an opportunity to meet to discuss the issues, the MP said HX bosses failed to show up.
    How surprising!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I tried our local MP, Lisa Nandy.

    Absolute waist of time.

She did nothing but forward the entire email I sent to her to HX and then send my partner HX's response that was the PCN was issued correctly and wouldn't be cancelled, sorry about that, I tried.

There is a little more to it, in short Nandy's office sent a form for my partner to fill in to allow them to act on her behalf (not my PCN) under GDPR, it was sent and they still just forwarded the email I sent to them, in my name.

HX response was that they had told me previously they won't discuss it with me and "as yet, have not received anything from my partner (her PCN)."

The response then goes on to say "As we have advised (my partner) on numerous occasions, the PCN was issued correclty and will not be cancelled"

Not heard anything from her but advised her on numerous occasions, that sounds plausible.

Lisa Nandy, if it doesn't get her on TV, she is not interested.

Defence was submitted a few days ago.

Recieved a letter from HM Courts & Tribunal Service acknowledging receipt of defence and saying that a copy is being served on the claimant (or their solicitor), they may contact us to attempt to resolve any dispute, if not resolved informally the calimant will inform the court that they wish to proceed. The court will inform us of what will happen.

Where they wish to proceed, the claimant must contact the court within 28 days after receiving a copy of our defence. After that period has elapsed the claim will be stayed. The only action the claimant can then take will be to apply to a judge for an order lifting the stay.

Letter dated 27th March, they are on the ball, it was emailed the afternoon of the 27th.

We may as well start writing witness statement now

Hi ibcus, this is exactly what happened to me, I think it is all an automated procedure designed to make you blink first and pay their extortion demands.

If you show that you are determined, and your evidence is strong, (and I believe the before and after photos are your trump card) then I believe they won't turn up at court , as in my case.

As I mentioned in my earlier post, get large, good quality pics and put them in with your witness statement to both the court and Gladstones. I got mine from Snapfish. Regards.

Incidentally, after I'd specified the court that I wished to attend, I received a notification from the court giving me a date nearly 4 months away for the hearing.
