    Question about printing the defence.


    Can you create a digitial signature in Adobe and use that instead of going to the trouble of printing, signing, scanning back in etc.


    Example, write defence in Word, save as PDF, open with Adobe, click Tools, click Fill & Sign, click 'Sign' in the new ribbon that opens at the top, add signature and move it to correct location on the document.

    Probably.

    Alternatively:

    Take a photo of you signature on very white paper and embed that image in the PDF document at the appropriate place.

    That method is known to work.

    I do not know whether your proposal is acceptable.

    However you do it, you must take the original signed copy with you to court.

    Hi ibs, beat them! They never even turned up. I'll be posting a report on my own site. Many thanks For all your help through this. I see that you have got a claim form, I wouldn't be too concerned. I think your non- compliant pofa is your way out.

    I believe HX are just putting all of the outstanding PCNs on their books to litigation, to see who blinks first, I think that if you are prepared to go all of the way to court they won't turn up. I will be watching the forum as your case progresses and hopefully I can help with your defence. Regards. Pjr.

    Hi ibcus, Important that you request a partially redacted copy of the log from the PDT machine and a record from the ANPR camera also partially redacted. Gladstones must provide these under disclosure of documents or information as part of pap within 30 days of request or give a reason why. ( make sure you keep proof of posting )
    I requested that information and they didn't send it to me. I also have what may amount to a breach of their contract with the land owner which I'll post a bit later when I dig out the particular clause. Make sure that you question their authority to enforce that car park in your defence, so that they send you a copy of the contract in their witness statement.Regards.

    Hi ibcus. This may be something or nothing, but in HX's contract with the land owner, in HX's company obligations:
    The company agrees : para 8 (d) 'These signs will carry a clear and unequivocal message that the vehicle owner's details may be obtained from the DVLA.' That message is only contained in very small writing in the white box at the bottom of the terms and conditions sign and in no way is it clear, in fact the font is so small as to make it unreadable if looking at the actual sign in the car park.     I have asked HX and Gladstones for data logs.


    Hx said no on several occasions then said the logs are deleted after 3 months.
    Rachels (DPO of HX) reply when I asked for logs was:
    As advised in my previous email, this contains personal data and as such, due to GDPR we are unable to provide this to you.
    I then asked for data logs [FONT=&quot]with all VRN data verified by ANPR to a matching vehicle redacted and with all other data left as is to only show [/FONT][FONT=&quot]incorrectly entered VRN details.[/FONT]

    Is it a concidence that the LBC was issued exactly 3 months to the day from the date of parking?

    I also asked HX when they took over management of the car park and when the PDT machines were installed on the site.


    HX wouldn't tell me that.

    The only thing HX or Gladstones will tell me is how much to pay and how to pay it.

    Hi. I sent a second SAR to HX requesting a copy of the data log for the pdt machine which contained the partial vrn that was was entered on my ticket because they knew that it was relevant to me (in your case 06) they had to send it because it contained data that related to me. They sent it and my partial vrn stuck out like a sore thumb among the empty columns of redacted vrns.
    As for data being deleted after 3 months. Your car is allegedly in breach of a contract and therefore they must keep all the evidence for court, so can’t delete it. As I said, request a partially redacted record of the ANPR images for that day from Gladstone’s because it contains evidence that you require for your defence, if in the unlikely event that they do reply giving the same excuse that unoffending vehicles are deleted, then surey they have tampered with evidence because you needed to prove there were no other vehicles in that small car park with the partial vrn 06.
