So surprised to be written out of my fathers will

Can this be challenged?

Hi,

Hope you are well. I just wanted to touch base on whether I have means to challenge my fathers will(produced in 2014) who sadly passed away 22/11/2017, it's a strange situation and neither me nor my sisters can believe what's happened but basically he has left me a monetary value of 10,000 however left his entire residential estate to the three girls and left me out(he had 4 children total) - The house is up for sale at 435,000 and I don't think I should feel guilty wanting an equal share, especially when it is life changing money and I really don't believe that if re written, it would look like this.

It's a strange place because my whole life he never really bothered with me and I only met him by chance when I was in my late teens and ever since then I had seen him often but he never came to see me it was always one way effort wise.

I would be so very shocked if the girls don't turn around and share it equally but do I have any options if they don't? As they are already doing things I did not expect. The funeral was recent and only then did I find out they already put the house up for sale without asking me, his only son and the only one to have taken his name

Thanks

Chris

  • You would need valid grounds to challenge the will, for instance if he was lacking in capacity at the time it was written

I don't see why the others should give you any of their money, they're under no obligation to do so.

One of those things I'm afraid, he must have had his reasons.

Are you in Scotland? The laws are different there, but even then I think it's only writing you out completely that's not allowed. Giving you ten grand is still a reasonable amount.
Unless I say otherwise 'you' means the general you not you specifically.

Your Father's money, your Father's choice to leave it as he wished.
If he wanted you to have the same share as your sisters, his will would have reflected that.

    My condolences on your loss.

I'm sorry that you are having to deal with both the loss of your father and the sense of rejection and bewilderment at being left out of his will without explanation. Unless you were financially dependent upon him, which sounds unlikely, or he lived in Scotland then he could do whatever he wished with his money. To receive more than the bequest you will be reliant on the goodwill of your sisters. I hope for your family's sake that this can be resolved amicably, but personal experience says that this sort of situation can create an irreparable rift.
  • I'd feel rather peeved too ... personally I wouldn't challenge it though, even if I could. Fair, right, or not - that's what he seems to have decided....

    Probably a clue here

Yeah, he always said the lack of effort was down to my mother being difficult, which is plausible.
  • Did your sisters grow up with him and have a different relationship?
  • As a parent, I'm unable to understand how any parent is able to favour one child above the other/s. It happens time and time again, causing deep hurt to those affected.

OP, I'm sorry for your loss and equally sorry that you have been treated in this way.
