Eviction worries

  • There was no way I could have afforded to pay 223 per week on part time wages so I know it was defenatly 109+5 from the court
  • This is what is one one vision site I have not had any correspondence with them asking to go for a meeting:
Only dealings I have had is when I have called them
If we have been granted a Suspended Possession Order and you break your agreement to reduce your arrears we will invite you to attend an interview, this will be with your Neighbourhood Services Officer to discuss your specific circumstances. They will review your case and come to an agreement to reduce your arrears. If you fail to attend the interview or do not reach agreement, we will return to Court to obtain a Possession Order and eviction proceedings will follow.

When I came out of work I had to reclaim housing benefit I didn't know how much to pay so I asked her and she worked out what I was entitled to and said that was the shortfall to pay I asked them on the 10th when I received a letter saying I had breached and they said it was 28 a week

So you have spoken to someone at the HA or is this the benefit lady?

    You are drip feeding information.

It may help people if you can answer ALL of the following rather than just some.
    • How much was your original debt at court in 2016?
    • How much did you pay weekly after the court order?
    • When did you stop paying this? (How many weeks?)
    • How much was your outstanding balance when you stopped paying?
    • When was this? (Sept 2017?)
    • How much to you owe now in Rent (not rent and court costs)?
    • What HB are you currently receiving every 4 weeks?
    • What is your actual rent now?

The difference will give you how much you are behind on your court order. You will need to know this information so It would be beneficial to sit down with you paper work or log into your rent account online via their customer portal https://css.ovh.org.uk/#!login and work it all out.

I have not had any meeting with anyone from 1 vision
So in the 18 months or more that all this has been going on, you've not even attempted to check that your debt is actually going down, and you've not even attempted to speak to the housing association about it?
  • Original debt was 2191
I was ordered to pay 114 per week
Which I paid every week from Feb up until 13 of September when I can out of work
I called one vision to inform them that I had come out of work and that I was claiming housing benefit for 2 weeks after this I paid 114 per week
Thinking my benefit would be sorted by then when I called them they told me to pay what I can until housing benefit was sorted
I now owe 1700 in rent arrears
One vision have not contacted me at all I have rang them
I have had no meetings with them at all
And now I am getting evicted and I'm not sure why as I thought I was paying the rent shirt fall plus 5 for the arrears
  • My rent has been going down it as 2191 and now it is 1700 so it has gone down and I had no need to contact them while paying the 114 as that is what they asked for at court and that was what was agreed on in court and they set up a dd for that amount of money to come out of my account so until I came out of work no I did not contact them

The housing association took you to court and got a court order for you to pay £114 per week? This was the £109 rent plus £5 towards the arrears is that correct?

When did you get written permission from the housing association to say that you could stop paying the £114 per week because you were no longer working? Phoning them up and saying that you can't afford the rent because you had stopped working is not going to stop you from having to obey a court order. You were ordered by the court to pay the £114 per week. From what you say you have not obeyed this order. That is why the housing association have gone ahead to get possession.

It is not up to the housing association to contact you over further rent arrears if you have broken the order of the court. This is up to you contact the housing association and work out how you are going to pay the £114 per week not to just tell them that you aren't going to do it anymore.

So your payment to the housing association was agreed at £114 per week. How much housing benefit did you get towards the rent?
