How can turn up at court though they have already been without my knowledge and got permission to issue a warrant0

I did get a rent statement only one missing was the 114 I should have paid but instead I paid the 21 and it showed my housing benefit payment also they were informed I had come out of work and told me to just pay the amount I was told to which I did then on the 10th when I rang was told it wasn't enough and I needed to be paying 28 to which he set up a dd to start coming out on the 1st Dec and for me to make payments via debit card til then which I have he then said not to worry now it's all been sorted but it obv hasn't as a week later dated the 16th Nov they went to court without my knowledge
as it appears the order was suspended, then, as mentioned above, it can be re-activated.
You need to have a meeting with the HA and go thorough your rent statement because it looks like you are missing some info somewhere.
The HA would not have reached this stage even if your payment plan was only £5 extra and thus you appear to be 20 weeks in arrears0 -
I was 17 weeks in arrears and I paid it every Thursday my payments are on my statements as is my housing benefit payment. On the 1 vision site it says a meeting would be held between myself and my housing officer before applying for the warrant. I never received notification of any meeting only a letter saying I was in breech and then a letter from the court saying permission had been given for a warrant0

I just really want to know if i can stop the warrant and if so how ? I have spoke to 1 vision and they never mentioned a warrant just to set up the dd and not to worry .0

You need some specialist advice. Try CAB or Shelter.

Was a money order issued with the warrant? This should tell you how much you actually owe. Make sure you have evidence of when, the amount and how you have been paying the arrears.0 -
No nothing just a letter from county court saying the claimant has permission to issue a warrant for possession.nothing else came with it0

I have told you how you can try and stop the warrant.
You will need to apply for a stay hearing through the court and turn up to it.
However the judge doesn't have to grant you a stay.
It is unwise to ignore the rest of the advice.- Call your HA on Monday
- Obtain an up to date rent statement
- Arrange a meeting with your income officer
- Apply for a stay hearing through the court
- Keep making payments
The HA would have had to satisfy the court that a warrant is necessary. Like I said the court doesn't just hand them out without good reason and evidence0 -
I'm worried sick. I've not slept at all. I have never been unemployed before.
So I thought I was doing everything correctly informing them.
And.making the payments the housing benefit told me to.make0 -
You need to make the payments your landlord have told you to make. It is nothing to do with housing benefit.
Your rent owed and any arrangement is with your Housing Association. Benefits just help you out.
They can advise but any payments should reflect what the court order says and any other agreement needs to be with your HA who charges you rent.0
